I would guess that they could both be charged with statutory rape if the State wants to. Probably also something having to do with not having a permit to display a sex act in public

It may surprise you to learn, Snake that outside of Dallas, slobbering the knob is relatively uncommon on metro buses. Indeed, in Idaho it is entirely unknown. You could look it up.
I remember riding the bus in high school. We had to ride between two different schools for about half an hour, and the buses were always crowded, with at least two people, often three to a seat. You could always tell when someone was getting head because there would only be one head visible. It happened at least once a week, and sometimes with more than one couple at the same time. The problem became so bad that we had to have different buses for each gender.

Here in Aus we have laws that prohibit ‘Lewd Behaviour’ which would cover this example perfectly. Do you have similar?

pkbites, I hate to be the one to break it to you, but kids watch sex acts all the time (usually in the form of dirty movies). Some of them even participate in sex acts themselves!
And–please don’t let this blow your mind–there’s nothing wrong with a little safe sex. Especially in this case, where there was no chance of anyone getting pregnant.
You’re right. But getting a large load of infected semen in the mouth can hardly be called safe sex. (yeah, yeah. I know, I know. We don’t know if the guy had any disease or not. that’s not the point)
The point is, children having sex with other children IN PUBLIC! is not acceptable. Burner and now YOU, I guess, seem to think it is. And in most places, it is in fact illegal. What’s your problem? These kids should be in trouble!

Well, I think it’s appropriate to discourage sex acts on a school bus. However, I think it should have been dealt with by the school, not by the police, and involving the spectators is ridiculous.
I can’t make statements regarding what should have happened in the particular state this took place.
however, in Wisconsin, as in many states, the school bus is run by a private comapny, NOT by the school. So this would have, in fact, been a police matter, as well as a school matter. Also, because of the students age, even if it had occurred in school, it would have been a police matter because it was sexual assualt. In many jurisdictions 15 year olds cannot consent to any form of sexual contact. The conduct of the observing juveniles was, at very least, disorderly conduct or disturbing the peace.
Once again, I admit ignorance of the laws of where it took place, but I’m willing to bet they differ little from here, mostly because of the actors ages. This was a police matter! Sorry, but those kids were wrong, and so are you.
pkbites: Sure, it was a “police matter” in the sense that the police have jurisdiction over the bus.
But the police don’t have to take action in every case where they are legally able to, and I believe this is one of the cases where they shouldn’t have. Nobody was harmed. What’s wrong with just giving the kids detention or suspension?

Once again, I will state that I am unaware of the laws in the state this took place. Also, seeing that I can only go on the little information I have been given, I can only go on that.
However…
I happen to have a badge Mr2001. And had I been dispatched to this, there would, at very least, been a DA referal as well as a social services notice for the 2 involved in the sexual conduct, and disorderly conduct citations given to the cheerers.
In this situation (at least here) I’d have no discretion about that.
I’d much rather have the DA kick the case than for me to do nothing.
Do laws against urinating on the street mean that people think urinating is “wrong on some level”? Of course not. It merely means that people think it is wrong to do it in certain places.
Mr2001, I don’t think we have enough information to judge whether or not it should have gone to the cops–what if one kid was being massivly pressured by the other kid and the spectators to participate? What if they have handled the matter without calling in police before, and it has apparently had no effect?
