Good to see the government can still fabricate charges for people. Maybe Barney Fife doesnt know what to charge them with because they didnt do anything illegal in the first place.
How about…
Indecent Exposure?
Blowjobs aren’t illegal (and if they are, the aw certainly isn’t being enforced.) Blowjobs on a freaking school bus with other children watching had better be illegal one way or another.
At the (public) high school I attended, we had a small handbook that stated our rights and responsibilities as students. It clearly spelled out that such behavior as mentioned above is clearly in violation of numerous rules.
I, for one, am glad that those involved suffered disciplinary action. I would’ve kicked them out of school, myself.
The fact that streaking is illegal does not mean that I’ve gotta take a shower with my swim trunks on.
This has to be one of the oddest OPs I’ve read in GD in a while - and considering some of GD’s denizens, that’s saying a lot.
The crime in question here is not having oral sex. It is having oral sex in public. And that’s always been a crime. What did you think the state of the law is, that you and your SO could walk into the Rotunda on Capitol Hill and drop trou and get nasty?!
Sua
Indecent exposure works for me.
Something to do with lewd behavior perhaps. Or how about an oldie - moral turpitude.
Whether oral sex is wrong or not is not EVEN the issue here.
YEAH! Save that kind of behaviour for the Oval Office!
It’s not illegal to give/recieve a blowjob. Indecent exposure, however, is illegal. I’m glad they got the police involved.
Indecent exposure would only apply to the dude with his wang out. So what are the spectators being charged with/ (or the girl giving the bj, for that matter)
Well, once the blowjob started, the dude didn’t have his wang “out”, so to speak, did he?
Depends on where you live.
15 States still have laws on the books, from Idaho, a Felony with max life in prison, to Florida with 60 Days and $500 max fine. This cite is Gay Law oriented.
When noggin is outlawed, only outlaws will get any noggin.
I propose a nationwide program of civil disobedience. As a straight male, my participation has certain obvious limitations. Nonetheless, I stand ready to accept the requirements of stern duty.
I can understand the ‘kids’ involved being punished, but the spectators? and how can you arrest someone without knowing what they’re being charged for?? That seems to me to be the most ridiculous idea I’ve heard of in this country - I would NEVER peacefully allow an officer to arrest me if he didn’t know for what he was arresting me.
Excellent, I mean really excellent stance. It is our patriotic duty to ensure our civil rights are protected to the fullest. That’s my story and I sticking to it!
Well, they probably, and she certainly, would be accessories to the crime!
More seriously, there are laws, varying from state to state, which criminalize sexual acts performed by or to persons under the “age of consent” – the point at which one is legally presumed capable of giving informed adult consent to a proposed sexual act. In addition, in something like 19 states, oral sex is included in the legal definition of “sodomy” as a criminal offense.
Even in New York, “consensual sodomy” is a class B misdemeanor, though the State Supreme Court has ruled that any prosecution for private activities which violate it is an unconstitutional violation of privacy. Getting a BJ on New Year’s Eve in Times Square, however, would presumably not be consistered an activity in which one has a “reasonable expectation of privacy.”
Glad to know that you are willing to stand up for the law, to stick it out until you have full civil liberties, and to come to justice.
Alas, it’s a Hard job but someone has to do it… Well, don’t have to but I would be pleased and grateful to the lass that would be so accommodating…
::sorry officer. I can’t seem to find my fishing license. I was sure I had one.::
Ignoring the obvious pun on what you did in fact say, I misread the fourth word as “Hand” …
:o
Sorry to hijack, but…
LIFE IN PRISON FOR A BLOWJOB?! I’m assuming between consenting adults. Isn’t that a bit cruel and unusual ?
What’s the punishment for rape in that state? If it’s anything less than life than the State of Idaho needs to get its priorities straight.
In California, fellatio is legal so long as both the blower and the blowee are 18 years old or older.
If the case described in the OP had happened in California, both the 16-year-old boy and the 15-year-old girl involved could be charged with a crime.
New York State’s law against consensual sodomy has been formally repealed.
Idaho’s law against “the infamous crime against nature” provides for a punishment of “imprisonment in the state prison not less than five (5) years”–there is thus no maximum term, so in theory someone could be sentenced to life imprisonment. The Idaho law against rape provides for a punishment of “imprisonment in the state prison not less than one (1) year, and the imprisonment may be extended to life in the discretion of the District Judge”. Here is a history of Idaho’s sodomy law.
Article 125 of the Uniform Code of Military Justice also makes consensual oral sex a crime for all persons in the military, whether on or off duty.
