Sqrl, I brought up your insert euphemism of choice here on Melin for 2 reasons.

  1. I wanted to let readers know where to find your assertions about BSA funding, since, for whatever reason, you posted them in the middle of your euphemism on Melin.
  2. I don’t normally quote myself, and wanted to explain my reasons for doing so. As it turned out, David was not aware of the points I had made in the earlier thread.

Maybe I’m missing something here, but the link you provided seems only to take me to the main IRS site & a daily news sheet. If I’m supposed to be able to check out a return from BSA through this site indicating that they received government funds, I would appreciate more information on how to do this.

Well, today’s Supreme Court opinion ends the debate here. in BOY SCOUTS OF AMERICA v. DALE (99-699), the text of which you can find here, the USSC has determined that the New Jersey statute that was applied to the BSA to force them to accept the gay scout leader violated the First Amendment (actually it violated the Tenth Amendment, but we won’t get into a long discussion of proper constitutional analysis of rights not specifically enumerated in the Bill of Rights :wink: ). Therefore, the BSA, and presumably any group which engages in “expressive association”. This likely would include any organization which espouses moral codes as part of its conduct. One does have to wonder if this means that the KKK could legally exclude non-whites even if determined to be a “public accomodation” under statutes like that used in New Jersey.

Part of the reaon that NJ applied the public accomodations law, if I understood correctly, was because the NJ court found that BSA holds itself out as being open to all boys, and that the view of homosexuality as immorality is not an fundamental part of the organization.Those two conditions wouldn’t apply to the KKK (or the NAACP accepting a klansman for that matter)
