That is, in fact, the way it is. The Supreme Court is the last stop and the binding arbiter. he Constitution says whatever the Supreme Court decides it says. That is our system. Legal “rights” are legal constructs.
And only 35,000 laws to start challenging. Give me a break.
Hey, the state has no obligation to slow things down for you, but it’s not like you have to challenge each instance of like legislation individually. If something like the 30 day law gets struck down for one state, it will have the effect of striking it down in every other state as well.
You guys won a big one in Heller. That as the one that mattered. All the rest is going to be this kind of nibbling around the edges, and don’t worry, there is ample money waiting to challenge them, but there is never going to be any kind attempt at sweeping prohibition. That’s been killed forever.
The big one is coming up this summer, Heller was just priming the pump.
Can I expect your celebration of the triumph of the system when the Second Amendment is incorporated as a result of McDonald vs. Chicago?
Yeah, this actually reminds me a lot of the anti-immigrant people who are “just concerned about breaking the law.” The amount I believe they would be placated by eliminating immigration laws, is the amount I believe Diogenes will change his tune if the Court invalidates the vast majority of gun laws this year.
I will be all for it if the court invalidates gun laws. Yes the system will have worked. I support the protection of the 2nd Amendment. my disagreement with “gun nuts” is one of style, not of substance.
As for McDonald, I think that the Supreme Court will most likely rule that the 2nd Amendment is an incorporated right (in fact, I think itwould be a good thing if all of Slaughter-House was overturned (incorporating the entire Bill of Rights).
I’m not sure it will overturn everything in McDonald, though it will probably find that the prohibition on handgun registration is an effective ban on handguns. I think it might let a couple of the registration requirements stand, though.
It will be interesting to see what the Court says. We will find out what is Constitutional and what isn’t.
I don’t know my leanings either. Some might say I’m somewhere in the middle, some might say I’m on the left. I don’t worry about myself with labelling msyelf. I’d probably be off the mark anyway.
