What are you talking about? Taney was NOT a strict constuctionst - the basis of Dred Scott was the ORIGINAL Substantive Due Process decision. It’s exactly what Bush is against.

You’re not listening to what the president actually said. The part that he got so dead wrong was not that it was an example of substantive due process. But that he claimed slavery was not supported by the constitution. Because in 1856 it most definitely was.
