Butler v. Butler: The GWTW Divorce

(I put this in Cafe Society because it’s about a work of fiction, but I’m not sure it belongs here)

Soon after telling her he doesn’t give a damn, Rhett files for divorce. What would his claim be? Would Scarlett have any counterclaims? Would there even be any grounds for divorce in 19th century Georgia? And could Rhett get Tara, or at least 1/2 of it?

Rhett could divorce Scarlett for refusing his martial rights (i.e. not having relations with him). This is stated in the book after she tells him “I don’t want any more children.”
