California SC overturns gay marriage ban

Indeed this is encouraging news! We have gay marriage (in all but name) in the UK and there aren’t any Nazis riding dinosaurs here either.

And I had just gotten an e-mail about organizing the 7 Straight Nights for Equal Rights event at my church again this year. Well that’s a lot of work I won’t have to do. :slight_smile:

I believe his position has been “the people have spoken” (through Prop 22). Of course now the court has spoken and told the people that they got it horribly wrong.

At least one SSM opponent is planning to ask the court to stay its ruling until after the November election. If the ballot measure gets certified and passed then those couples who marry in the interim could find themselves in a legal limbo.

None that I know of. Of course it won’t matter except in those states which already have SSM (MA and, sort of, IA) or those that recognize out-of-state SSM (NY and I assume NJ and VT, possibly others) It’s probally a good thing that the San Francisco marriages haven’t revalidated.

Both alive (Del at 87 and Phyllis at 83), still together after 56 years and still active in the movement.

I hope not. The ruling doesn’t go into effect for 30 days.

We already have “gay marriage (in all but name)” in California and have for many years. In CA, same sex couples can have a Domestic Partnership which confers the exact same rights as marriage. In fact the forms to dissolve a domestic partnership are exactly the same as the ones for a marriage. You just check one box or the other.

This is great news but there still might be a way to go. Can this be appealed to the SCOTUS? If so, it probably will be. There is going to be an initiative to amend the State Constitution to ban it that way. Eight years ago the initiative that was just overturned passed by a pretty good margin. Have things changed enough over the last eight years that this new initiative won’t also pass? I don’t know?

It’s time to celebrate and then tomorrow get back to work. It ain’t over yet.

There was no federal question raised at trial so no appeal to SCOTUS is possible. However, SCOTUS has already ruled that same-sex marriage bans do not violate the US Constitution.

This has to be at least the third time I’ve typed this in three different threads.

One couple I know wants to charge over to the courthouse tomorrow! Another are probably more than married due to all the paperwork, but they are still gonna do the courthouse thing.

Please, please let this thing stand. The rest of the country will follow CA, I think, then in 20 years we’ll be wondering what the hell all the fuss was a bout. But it’s a bloody fight for now.

Can domestic partners marry eachother without dissolving their partnership first? :confused: I suppose the domestic partnership law will need to be changed to allow opposite-sex couples under 62 to partner as well.
