What’s really weird about this is the press can’t even mention “the wife’s” name any more. Mary Elizabeth Harriman’s name has been in the news for a year and a half and now suddenly no one can utter it?

Wild and wacky stuff.

That was the same deal with the 13 year old Medicine Hat girl who killed her family (with the help of her older boyfriend) - you can look up her name on Google if you want, it’s right there since she was reported as missing before they realized she was a multiple murderer, but since she’s a minor, I can’t type it here and nobody in the media can publish it.

What about emailing members, is that publishing?

I can understand limiting the publications of a newspaper or television station, but limiting the speech of an individual seems rather unAmerican. Oh, wait…

Where do you see that in the linked article? This is all I see about the restriction:

On Tuesday, Justice Jennifer MacKinnon ruled that until there is a divorce trial in open court (unlikely if Williams and his wife mutually agree to part ways), then the domestic contract should not be available to the public.

**The judge also sealed sensitve portions of the woman’s medical records **that were put before the court.

Sorry. Perhaps the linked article wasn’t clear. But all over the news radio programs that I listened to, on both CFRA and CBC, they mentioned that the “wife’s” name could no longer be (what’s the legal term I’m searching for?) mentioned.

Her name is Harriman, and there is no order against using her name or discussing the case.

There is a temporary order that bans publication of her domestic contract (the separation agreement she made with her husband), and her doctor’s affidavit and report and the contents thereof, until the court decides on whether or not to seal the entire divorce file. That motion is set to be heard on 24 March 2011.

Nothing formally reported yet, but according to the 15 April 2011 Ottawa Citizen article, the motion to seal the record failed, and the temporary publication ban remains in place.

I was told specifically by the Powers That Be here to not post her name here - seems we are bound by the laws of the country that this board is in and also by the laws of the country that we’re in, which more or less makes sense, I guess.

There is no law or court order prohibiting our naming her or discussing the case on the SDMB or anywhere else. I have posted the link to the order for the publication ban at post #147.
