Sounds like a bunch of twaddle to me. In any case the “ex post facto” was when they commuted their sentences in the first place. The new law should have only applied to future cases, everyone that was duly convicted and on death row should have been executed.
The Supreme Court of California ruled that the death penalty was unconstitutional under California’s Constitution.
That meant that all death sentences were null and void.
If the State of California had executed those under unconstitutional sentences of death, they would have been committing murder.
After the voters of the state passed a. Institutional amendment authorising the death penalty, and after the Supreme Court of the United States held that the death penalty could continue in certain circumstances, the Legislature of California passed a new death penalty law in the late 70s. That law could only apply to events that occurred after it came into force, not to murder that occurred before it did.
An attempt to apply it to previous murders would be ex post facto and unconstitutional.
Re: Charles Manson’s future mortal remains.
The deal with his engagement a couple years ago was that his fiancée was trying to get dibs on his body to exhibit it when he kicks the bucket. No romance involved.
Not sure with his weirdness if he thinks a post-life on display is a bad thing or not.
