Civil Trial: Trump v E. Jean Carroll (Carroll wins, awarded $5 million, plus 83.3 million)

Paging Doonesbury:

The complaint alleged that there was battery that included first degree rape, third degree rape, first degree sexual abuse, third degree sexual abuse, sexual misconduct and forcible touching, all of which are different crimes but any of which could have constituted battery, and which qualified the case as being timely under the new NY law reopening the statute of limitations. So any one of those things happening would have sufficed, and the jury was asked about all of them.

This is by far and away the most common situation. One vote, “Let’s eat!” then return the verdict.

I did find it interesting that one reporter on MSNBC said that at least one juror was a total MAGA person who took all his news from one hard right wing source (the name escapes me). Yet he still found for Carroll.

This is why I generally trust juries to get it right when presented with good evidence.

Two her titles are A Dog in Heat is a Hot Dog and Female Difficulties. Prescient and ironic, in retrospect.

For many of them, they actually LIKE that he sexually assaults women. The agree with him that this is what powerful men are allowed to do. “Fortunately” for them, in Trump’s own words.

e jean carroll has the biggest smile ever on her exit from the court house. seriously ear to ear.

Thank you for the thorough explanation. My internet pooched 2 weeks ago and I was substantially out of touch during much of this trial, unable to follow it regularly. How you explain it makes total sense.

Trump just said on Truth Social that he had no idea who Carroll was and it’s all part of the biggest witch hunt ever.

Learned it 5 minutes ago myself!

Can Trump be taken to court again if he continues to defame her by lying about her?

Looks like $5,000,000.00. As mentioned above, we’d want to see the verdict form, but the below offers perspective.

$2,000,000.00 - For the unwanted touching, jury said it was battery (unwanted touching) and “abuse”, but did not find it amounted to rape. In theory it could have been all - battery, abuse, rape (all rape includes unwanted touching…obviously; I’m less clear how they are defining “abuse”).

Late edit: Judge Lewis A. Kaplan said that for the jury to establish that Trump raped Carroll, she had to prove that Trump engaged in sexual intercourse with her, and that he did it without her consent. The judge said that sexual intercourse includes “any penetration of the penis into the vaginal opening.” - per NYT

$3,000,000.00 (total) for the defamation aspects.

An unofficial transcript…(per Inner City Press)**

Judge Kaplan: Clerk will publish the verdict.
Clerk: As to battery, did Ms. Carroll prove that Mr. Trump raped Ms. Carroll? Answer. NO
Clerk: Abused Ms. Carroll? Yes. Dollar amount: $2 million

Clerk: Wonton disgard? Yes. $20,000. Defamation? Yes. Trump’s statement false? Yes. Actual malice? Yes. Injured? Yes. Amount: $1 million. Reputation repair program: $1.7 million.

Clear: Wonton? Yes. Amount: $280,000.

Please check my work and/or let me know what I’m getting wrong.

**I don’t know that this transcript isn’t leaving out parts. After the last sentence, Defense attorney wanted to poll jury so I know that’s the end. But again, not sure if there’s missing stuff in the middle. I’m adding this edit based on Jimmy Chitwood post above describing the various types of sexual abuse. Maybe an answer of “no” to rape makes all the different types moot.

Wanton. But it still works.

Maybe so, but I’ll go out on a limb and predict much bigger witch hunts still to come

Trump: “They accused me of eating Wontons! I only order the fried rice! I never have the wontons! Deep state! Witch hunt!”

ha, yea. I just copied and pasted, though. Didn’t want to edit anything.

Man, wouldn’t it be amazing if the court could just keep tacking on additional damages every time he continued to lie about and defame her?

judge privately cautioned jurors about identifying themselves or each other upon releasing them.

the talking heads are saying that rarely happens, mostly in organized crimes cases.

Trump is the champion of disorganized crime.

And Trump is the wish dot com version of a mob boss.

Wondering if the CNN “Town Hall” with Trump will continue as scheduled? (Tomorrow night.)

And if it does, will this be addressed? And will Ms Carroll have her lawyers (well, their law school interns) at the ready to take more defamatory statements, if needed?
