I’m curious to learn what legal mechanism he’ll use to bring this to the Supreme Court’s attention. He’s seemingly exhausted all options and he’s not in control of the funds set aside in escrow after the first verdict.
Rule 44 allows them to ask for a “rehearing”. But they better be careful.
The petition shall be presented together with certification of counsel (or of a party unrepresented by counsel) that it is presented in good faith and not for delay; one copy of the certificate shall bear the signature of counsel (or of a party unrepresented by counsel).

It’s not like Trump would ever say ‘well, this isn’t in good faith, I better not do it’. Just like he’d have no problem finding someone to sign whatever needs signing. Didn’t Habba sign something stating that she personally checked every last drawer and cabinet and hidey hole at Mar-a-Lago and didn’t find anything?
Didn’t he claim he misidentified her because he wasn’t wearing his glasses? (Which he would never be caught dead wearing in public anyway, or in a videotaped deposition.)
As Brian Taylor Cohen pointed out, her lack of consent is what started this entire thing.

Yep. The judge ordered it to be disbursed and it was appealed to the 2nd. At some point is he declared vexatious and fines start being issued?

Judge Orders 5 Million Dollar Judgment Released

A federal judge on Wednesday ordered that the writer E. Jean Carroll should promptly receive a $5 million jury award, days after the Supreme Court rejected an appeal by President Trump and despite his last-minute attempt to get the justices to reconsider.
In a two-page order, Judge Lewis A. Kaplan of Manhattan federal court cited the Supreme Court’s June 29 order denying Mr. Trump’s request that the justices review the matter. That cleared the way for the funds, which Mr. Trump had deposited with the court, to be released to Ms. Carroll.
I remember it distinctly as “Omnia Gallia in tres partes divisa est.” I see there are different cites on line, but in Latin of the time, the verb almost always came at the end.
Perhaps. Trump is trying to appeal that order, as well.
I don’t think it’s going to work. At least not for long. SCOTUS is done with him on this issue.
Oh, I agree; it sounds like part of that appeal is trying to appeal SCOTUS’s refusal to consider the case (which is very much a Hail Mary attempt). But, even so, it’s Trump’s standard “exhaust the opponent with filings” strategy, and it means that Carroll still isn’t likely to be paid immediately.
I suspect the next order out of SCOTUS will be something like, “Appellate action (however Trump styles it) denied. No further review will be granted or heard in this matter. Funds ordered released to Plaintiff forthwith.”
Isn’t that basically what they’ve already ordered?
I don’t think they’ve said anything about no further review being granted. That would be an unusual order, if only because in most cases, it’s unnecessary to point out the obvious.

My read is that while it’s utterly possible we get the best case (?) scenario of the SCOTUS asserting “independence” of Trump on the 5 mil (while still supporting the countless other, more substantial/evil policies), they don’t loose anything either if they say they want to consider the bundling of two related claims in full session, and giving Trump at least another few months, which could end up being quite stretched out given sufficient will and timing.
I guess what gives me hope (usually over-optimistic and futile) is the comparative speed at which they denied review. If they want to give him more time, their default tactic is to sit on making a ruling for as long as possible. They’ve done it over and over again for him. But they didn’t in this case.
By what date, using your best guess, will the money be in her hands free and clear?
