Would any of the lawyers here care to comment on the likelihood the Court of Appeals for D.C. will find that the government must comply with congressional subpoenas? If so, will the USSC overrule? It would seem to me that the allowing any administration to simply refuse to comply with subpoenas flies in the face of checks and balances. How could congress investigate anything and perform its oversight duties if subpoenas can be ignored? Is there a good argument that the courts have no jurisdiction to settle spats between the other two branches? IANAL but the stakes here seem to be pretty high.
