Company repeatedly denies court order to hand over source code, no one goes to jail ?

I was just reading this article about court cases involving election breathalyzers (and their manufacturer’s refusal to hand over their source code): Tucson Citizen - The Voice of Tucson

So my question is why has no one gone to jail ? Surely if they are fined, and still refuse to hand over the code, then stronger sanctions are needed ? Isn’t that pretty much the definition of “Contempt of Court” ? I realize this may hit GD territory pretty fast, but factual answers would be appreciated :slight_smile:

I just want to say that I hate such use of “decline”. One declines an invitation but one refuses to obey an order. To say one “declines” to comply with an order can only be used in the most sarcastic way. For instance: “When the International Court of Criminal Justice ordered the USA to hand over the indicted G. W. Bush, the US government declined”, meaning the court has no enforcement power and the US government considers the “order” rather like an invitation.
