I was involved in a car accident a few weeks ago wherein a car rear-ended me and pushed me into a third vehicle. It was obvious I was not at fault, and I am handling the repairs through the insuance company of the owner of the car that hit me. They have accepted fault and are having my car repaired. However, The insurance company has been less than cooperative in providing prompt restitution and the result is I have had to pay most of my incidental expenses (mainly rental car fees) out of pocket while I wait for them to reimburse me at their leisure.
This accident occured when I was out of town. I opted to leave my car in the other city for repairs, rather than have it brought back to where I live, since I was told I’d be responsible for any damages that might occur to it if it was towed (or carried) back. Don’t know if that is true. It is advantageous to the insurance company since bringing my car back on a flatbed truck would have been expensive.
The result is that I will have to make an unintended overnight trip to the other city (~5 1/2 hours away) to get my car when it is repaired. Is the insurance company obligated to pay for my time and lodiging in this case? If so, what is reasonable compensation to ask for?
