Lawyers for Greene say she isn’t an insurrectionist and that disqualifying her would violate her First Amendment rights. She previously told CNN that she had “never encouraged political violence and never will.”

Oh, another interesting part of that article is how a Trump-appointed judge struck down a similar challenge to Madison Cawthorn’s candidacy:
The anti-Greene challenge was brought by the same groups that unsuccessfully tried to remove Cawthorn from the GOP primary ballot in North Carolina. A Trump-appointed federal judge shut down that challenge, ruling that a Civil War amnesty law passed in 1872 still applies and therefore shielded Cawthorn from being disqualified over his role in the January 6 insurrection.
Cawthorn has denied any wrongdoing regarding January 6 and says he isn’t an insurrectionist.
Some of the leading experts on the Constitution’s “disqualification clause” criticized that judge’s conclusion. And on Friday, so did Totenberg, the Obama-appointed judge in Greene’s case.
“I don’t think that the Amnesty Act likely was prospective,” Totenberg said, siding with the challengers, who said the 1872 law was retrospective and didn’t protect future insurrectionists.
Bryan Sells, attorney for the challengers, who are backed by the legal advocacy group Free Speech For People, piled on, saying, “The absurdity of his argument shines through like a beacon.”
Oh, so what that judge is saying is that as long as you’re in Congress, you can try to overthrow the government whenever you want to and not lose your job unless your voters vote you out.
Maybe not. OJ was sued successfully for a wrongful death judgement despite being acquitted of murder in a criminal trial. Different courts and different jurisdictions might have different thresholds to meet for a case.
Now, I’m just saying this is possible, I don’t actually know for certain. But it’s not necessarily the case that a criminal conviction is required.

Getting ready to do some really fancy Articles of Impeachment against the entire Biden admin? Or subpoenas for every member of the household of every federal employee on the Executive Service scale? Building a case for that the Speakership election only requires a plurality within the majority, and can be given to a non-Member? Preparing for a series of attempts to disqualify the candidacies or elections of specific Ds, as some persons and groups have called for being done to herself and Cawthorn? Arguing that armed private bodyguards should be allowed inside the Capitol? The possibilities are endless.
She’ll be having a little chat under oath on Friday that may require his legal expertise. It’s not a criminal trial, so pleading the Fifth won’t be overly useful. And it will apparently be broadcast live. Not sure if Eastman will actually be there for her, but we can hope.
It’s a good thing. For all these months, people who actively connived at overturning an election have seen very little in the way of consequences. Sure, some who actually did physical damage inside the Capitol building have seen some legal penalties…but all those such as Greene who helped things along without putting herself in danger in that 1/6 mob, have skated.
And all those watching have seen that there have been no consequences. Conclusions, inevitably, have been drawn.
For this to be televised is important; people need to see someone facing some blow-back for what they did.
No, you did not. MTG is testifying in a lawsuit some patriots brought against her candidacy on 14th Amendment grounds. Other such cases have been tossed without getting this far. This judge, however, is going to get things into the legal record.
