First, I apologize for the awkward phrasing of the title. I could not think of a better way to express the concept.
Second, I don’t want to start a political poop storm. This is hypothetical based on the appearance of current events. I’m not assuming or claiming that anyone has done what I am asking about.
Having said that, what would the consequences be for an AG who promises to recuse him or herself from an investigation, but then DOES get involved in that investigation, especially to its detriment? Is it a crime or a breach of conduct? Who could make an allegation?
I guess I’m confused about our current AG Sessions’ actions in the Trump/Russia/Comey situation. If he has in fact done something inappropriate, what happens to him?
IANAL. But if the recusal was self-imposed, it can just as easily be self-unimposed. So - no, no consequences.
Here is a thread killer for the topic, at least as it pertains to Sessions.
Except presumably political. Anything a member of the government does, however legal or innocent, might have political consequences.
That was very helpful, thank you.
Violating even a voluntary / self recusal is an ethical violation for a lawyer. He could be disbarred.
He may have committed felony obstruction of justice and be prosecuted for that if the motivation for his actions in this case was actually to impede the FBI’s investigations.
