Court: New Orleans cops don't need warrants for brief home/business searches

Or so claims this article; it seems to imply that this only kicks in “when an officer fears for his safety.”

There are, of course, assurances that this ability won’t be abused, with a New Orleans PD spokesman saying that “There are checks and balances to make sure the criminal justce system works in an effective manor <sic>.”

What do you all think? Overturned on appeal? What sort of effect will it have on the rest of the nation? Anyone have more details on what the ruling really says/means?

What do I think? I think the article is a complete pile of garbage with not nearly enough informaton for the reader to make any sort of assessment of the decisions impact on life and liberty. They don’t even offer up an example of what would be a valid search under this ruling.

When an article generates nothing but questions, the reporter hasn’t done his job. Perhaps they’re planning a more detailed follow up article, I’ll reserve judgement on the issue until more facts come out.
