I guess the lesson learned is to do these things on IRC where you’re not paying a content provider and the channels aren’t moderated by IRC employees. Yahoo probably falls into the same because they moderate their chat rooms and have to report things, but from what I’ve seen, IRC is a free-for-all and pretty much always has been (at least on EFNet and Undernet).

Seriously, I’ve recently stood up for catsix (not that she seems to need it especially) over this annoying tendency to call her a traitor to her own sex on the least excuse. And if the truth be told, I believe I would do her in a heartbeat but for one or two inconveniences…
such as being too old, too fat, too married, too devoted to my two small boys, too separated by the Atlantic Ocean, and that’s before we get onto the vexed question of whether in a million years catsix would, in fact, want me to “do” her. 
IIRC from the TV reports I’ve seen about this, there was a woman who was going to go along with this but changed her mind. Then she saw that another woman was not only going to kill herself but her two kids as well, so she reported him. This seems to be the point where it crosses the line from choice to murder, morally at least, if not legaly (IANAL). If you are going to kill your kids and I encourage and facilitate it, I think I’d be guilty of conspiracy or something, whether the planning took place face to face, on the phone, or in a chat room.
Also I wonder if there are any laws about encouraging the mentally ill–or anyone else–from doing harm to themselves or others.
Actually AOL did not monitor chats, email or IMs.* Well, except for the Kids Only chat rooms which are monitored. Members had to report the threat for AOL to know about it. I imagine it is the same with Yahoo though I don’t know that for sure. In any case if it was reported in IRC AOL, or any other provider, would still be responsible for reporting the incident. Tracking down the people would be a tad harder but I do not think it is impossible. I don’t know much about the technical details of IRC but it should be possible to track the IPs of the rooms members back to the service providers.

- Yeah, seriously, AOL does not monitor this stuff. It has to be reported by a member. I don’t know how many times I had this arguement with members who thought we were reading everyones email, IMs and chats. The number of emails that went through AOL at the time I worked there was ~1,000,000,000(yes, a billion) a day or some insane number. There is just too much to monitor. Same with chat and Ims.
But I wasn’t saying that the internet is different than real life; I was saying that suicide is not murder.
My point of contention was not that the internet should be legally different than in-person contact, but that making comments that may or may not lead someone to commit suicide is not the same as murder.
Being held liable is not the same as being guilty of murder.
And that wasn’t the point.
IRC servers are generally operated by ISPs that are concerned with what happens therein. In another channel years ago, we had an issue with an abusive person. We reported him and his IP address to the ISP that ran the server, and the ISP promptly G-lined his ass. (G-lining is similar to K-lining, except that it applies to the network as a whole instead of one server.)
