DBL Jeopardy--the movie

Ok, this turkey is now out on cable/tape. I have a real problem with the central premise of the movie. I believe she COULD be convicted again… the prior charge would have been, “On or about (date) the accused did…”. The NEW charge would have a different date. After all, if you robbed a bank, got convicted, then when back & robbed it again…

Any thoughts?

You know, I have NO excuse either, because I know that Double Jeopardy only covers the SAME crime, it doesn’t allow you to kill someone that you just were wrongfully convicted of in the first place.

THAT said, can you believe in just SIX short years that guy could set up not just one mind you, but TWO prominent lives?? He could really get around!!

And her!! She is SO brilliant as to find him, then she turns dumbola and rings the doorbell of the guy, who at the very least framed her, which I would think, hey, wouldn’t he be a criminal and a sneaky hateful person. But, no, she trusts him again and again!!

I’m YELLING at the tv, ‘that kid in the cemetery isn’t yours lady, your killer ex just paid him to run you through there.’

But does she listen? Nah, she gets plunked on the head and into a coffin where MOST people would panic, but not she, she turns smart again!

I mean, make up your mind, she is either the brilliant person who figures things out and gets them accomplished or an idjit. You aren’t allowed to be both that much of the time!!

Ranting over!! I would call it a turkey, but why insult the turkeys of the world??

We covered the factual part of this in another thread, some time back… but in short, yes: the woman could be tried again. For double jeopardy to apply, the crimes must be the same in law and in fact. If that weren’t so, I could rob the 7-11 on the corner today, get arrested and convicted, get released, and rob it ever afterwards with impunity.

Well it seems to me that robbing a store can indeed happen multiple times, so no double jeopardy there. Killing someone can only happen once.

However, I did feel that there would have to be some way for the courts to convict her if she did indeed kill her husband for real.

Then again, why do we put so much thought into something that is supposed to be entertaining?

Also, I think the movie glosses over the fact that she could be tried for assaulting a parole officer, fleeing the scene of an accident, theft, illegal use of a handgun, fraud, breaking and entering, and battery; all this committed while on parole.

Oh, and I forgot the most serious crime of all: guilty of being incredibly HOT!

Kind of gives a whole new meaning to “suspended disbelief”, eh?
