DC Court of Appeals rules against Trump Immunity, SCOTUS Makes a Different Decision

Yes, we’ll know soon.

The worst thing they could do is take it up and then delay hearing it until their next term, which would put the insurrection trial out of reach before November.

But based on how fast they’ve moved in other cases (documents case, e.g.) and the thoroughness of the DC Circuit’s ruling, I think they will deny cert quickly on this one.

In the minds of those who can’t think their way out of a paper bag, Trump has successfully conflated political actions with legal ones. It’s very unfortunate and will take a long time to undo the damage. I despise him for it.

I believe that if the SC denies cert they don’t usually give reasons or dissent, it’s just “no”?

That’s why this is a relatively palatable path for them politically if they don’t want to help Trump, nobody knows which justices agreed with the decision, and they pass the buck to the DC courts. Whereas the 14A decision we’re going to know all the details of where they all stand.

I don’t know the answer to this – hopefully someone else does – but I say he’s welcome to try!

If he asks for an extension from the DC Circuit, I can already read the one-word response: “Denied.”

If he asks the SCOTUS, he’ll run out of time before they can rule.

I would hope they deny cert within 48 hours.

It’s going to be nervewracking, I hope we’re not just talking ourselves into this. I don’t think it’s an exaggeration to say that the future of this country could hinge on what they do here.

On the Supreme Court denying cert: leading lights among the Most Deplorable will be working to ramp up pressure on the Justices. And by ‘pressure’ I mean death threats.

The Most Deplorable will be aware of how crucial this decision is for Trump’s future. And their futures, of course, are tied to his.

We may never hear the details. But I’d be willing to bet that there will be a marked uptick in threats against the Justices and their families. (‘Help Trump OR ELSE’ being the general tone.)

I assume they will set deadlines for Trump’s brief and a reply brief, so we are talking a few weeks at a minimum.

So I’ve thought about this. Given the standard of Trumps legal representation (and the fact its in their interests to wait til the last minute to shave off a few more days until the election) there is not completely insignificant chance of this happening. if they do is that it? Grown up rules, no backsies, no appeal for you?

Well, let me just complicate the apprehension by saying that I just heard court watchers far more experienced and expert than me speculate that the SCOTUS will not deny cert, because they will want to be seen as putting their imprimatur on such an important landmark decision (it’s really not one, IMHO), but that they will split the baby by expediting this important landmark decision.

I just want to amplify this really salient point.

If you’re the Supreme Court of the United States, you’ve watched his behavior, and you understand the broad outlines of Project 2025, then you undoubtedly realize that you hold the fate of the Constitutional Republic In Your Hands.

Trump is effectively aiming to attempt another self-coup. There were significant lessons learned from January 6th and the “alternate slate of electors” scheme. He needs henchman, reminiscent of the Mafia – not people loyal to the Rule of Law and the Constitution – staffing every position in his government.

If Trump takes office again, one thing he really doesn’t need … is a Supreme Court – particularly one that doesn’t wholly comprise his errand boys (yes, probably boys) from the Federalist Society farm team.

I’m putting my money on them denying cert.

Hmm. If that’s their perspective, why not grant the motion to expedite in the first place.

They should deny cert and it might cut down on the death threats a bit more than actively taking up the case just to say, “Yeah, what the DC Circuit said!”

But little makes sense to me about this Supreme Court except that they wish to preserve their own power and they’ve got a (Federalist Society) long-range plan.
