I’d like to add an anecdote to this thread, because I think it’s somewhat relevant:
Many years ago I was participating in a thread on another message board about TV. In the middle of the thread, out of nowhere, someone posted a post that looked like this: “CHILD PORNOGRAPHY FILTH TO AIR ON TLC!” and explained that TLC was going to show a young girl’s naked bits, on this show to air at this time.
Well, I watched the show in question, and here’s what I saw: there was the briefest of scenes where the girl, about 10-11, in her bathrobe, was talking to her mom. She moved her legs and her robe opened just so, and if you knew to be on the lookout for it (and I did, because of that post), you got about two frames of a a glimpse of what could have been the young lass’ pubic mound before the camera cut.
I mention this because, had the guy not mentioned it, a) I wouldn’t have even watched the show at all*, and b) even if I did watch the show regularly, I likely wouldn’t have seen the girl’s bits unless I had known to be on the lookout for them. In other words, the whole thing would have been a non-event had it not been for the fact that the guy publicized it.
Kind-of an example of The Streisand Effect, I suppose, and I think the same thing applies here. No one would have given the un-pixelated shot of Ms. Niezewitz’s vaj a second thought had she not made a big fuss of it.
*I watched the show not because I had any interest in seeing the naked bits of a young lass, but because I wanted to see if the guy was telling the truth or (as I suspected, and as was proven) the guy was over-hyping a non-event.
One of the oddest aspects of Ms. Niezewitz compalint was that she’d watched the show with her grandmother, who was disgusted by what she saw and is now mad at her granddaughter.
Wait… you sat with your grandma and watched a show in which you KNEW he’d be seeing you naked? And Granny was okay with all that UNTIL she saw a little more than she expected?
So, Granny was watching you frolic around nekkid, seeing your bare butt and barely obscured boobs, and was trilling, “Oh, I’m so proud of you” UNTIL the crucial moment? Then she saw a split second of naughtier bits and THEN disowned you???
And the judge has spoken. Nizewitz’s lawsuit has been dismissed and she was ordered to pay Viacom’s court costs.
Apparently Nizewitz argued that while she signed a written contract, there was also a verbal agreement with the producers that they would blur out her anus and vagina (I’m using these words to comply with thread custom). But the judge noted that not only is a verbal agreement generally not enforceable, the written contract that Nizewitz signed explicitly stated that any verbal agreements weren’t enforceable. The producers had the legal right to promise Nizewitz anything and the contract said they weren’t bound by it.
Ouch! How many hundred dollars per hour were the attorneys who work for Viacom charging?
I get the distinct impression that Nizewitz is going to have to do something to raise a lot of money in a short period of time…

Where does the judge say that? I don’t see it in the HNGN article you linked to, nor in the Deadline Hollywood article it links to, nor in the original dismissal motion it links to.

I don’t think it’s quite that bad. Court costs are not the same thing as legal expenses.
