The decision is expected to be announced in a few minutes.
Live stream:
Djokovic’s application is unanimously dismissed with costs.
He’s out.
The stubborn asshole still has legal options left*, though they are very unlikely to succeed, and certainly not in time to be of any use. So yeah, let’s hope the screen door doesn’t hit his ass on the way out. It remains to be seen how much trouble he tries to cause before he’s physically deported.
I thought the Chief Justice’s reasoning was excellent, in the sense that I fully agree with it
… relative to this:
… which is almost word-for-word the court’s preamble prior to announcing the verdict – it’s not about the merits of the minister’s decision, but about its legality. Exactly right.
* - For example, as noted previously, the option of a “temporary bridging visa with conditions” that would still allow him to play. But the court can’t grant such a visa, it can only request the minister of immigration to do so, and the minister will certainly refuse.
From ABC:
As Chief Justice James Allsop outlined before announcing the decision, the court’s job was simply to consider whether the decision made by Immigration Minister Alex Hawke was unlawful, irrational or legally unreasonable.
The court found the grounds outlined by Novak Djokovic’s lawyers failed to demonstrate that.
It means the decision made by the Immigration Minister Alex Hawke to cancel his visa stands.
Djokovic will be deported from Australia, will be unable to compete in the Australian Open and may face a ban on entry to Australia of up to three years.
That was great match.
Novak took the first set with Medical Exemption. Border Force struck back with Exemption Denied. Djokovic stormed back in the third set with My Lawyers will Appeal. Minister Hawke won a long and grinding fourth with Visa Revoked. And the final set and match goes to Federal Court with Decision Upheld.
Final Score: Australia def N Djokovic 2-6, 6-1, 5-7, 7-6, 6-3
And thank the gods it’s over. Now, let the tennis begin!! ![]()
The best thing that No-Vax could do right now is leave quietly and hope that he isn’t banned from future entry to Australia. Causing trouble is more likely to result in a ban. What would be funny is if he was denied boarding on an airline because of his unvaccinated status, so that he had to return to Serbia on some ancient rusting freighter. Fuck him and his anti-vax bullshit, not to mention his lying.
IIRC, Serbia has similar rules on unvaxed folks being afforded safe passage, citizens or not. So poor Novax might have to spend the rest of his tennis days circling the world
begging for asylum from all those nasty regimes who require a vax certificate. Le sigh, le pisse laughing.
You win the match Sir. Well done, bravo. ![]()
Looks like No-Vax is taking my advice. From the latest CNN live update:
In a statement released after his appeal was dismissed on Sunday, Novak Djokovic said he would cooperate with authorities in arranging his departure from the country and confirmed he would not be playing in the Australian Open.
He said that while he was “extremely disappointed” in the judge’s decision, “I respect the Court’s ruling and I’ll cooperate with the relevant authorities in relation to my departure from Australia.”
According to something I just saw on CBC News, a 3-year ban on future entry is normally also imposed on someone who is deported from Australia – that is, it’s the norm rather than an option, though exceptions can be made.
From CNN:
The organizers of the Australian Open have now replaced top seed Novak Djokovic following his failed attempt to halt his deportation from Australia.
The new order of play inserts Salvatore Caruso in place of Djokovic. The Italian will face Serbian player Miomir Kecmanović.
Third seed Alexander Zverev will now move to the center court slot previously occupied by Djokovic. He plays Daniel Altmaier.

AP story here:
Apropos of nothing, google translate tells me that “најмања виолина на свету” is Serbian for “the world’s tiniest violin.”
This whole thread was worth it for this post (only quoting the first line, but what a great post!):
And this:
And this:
In a nutshell, he missed two shots and was out of the tournament.
To my mind, Djokovic’s personal opinions on vaccinations are not relevant. He asked to be a guest of a country he is not a citizen of, but refused to abide by a well known condition of being granted that status. I don’t for the life of me understand how a person could, with a straight face, even want to fight that. If you do not wish to abide by such a rule, don’t go.
It’s the “You’re not the boss of me” principle.
So what happens from here? He obviously wants to break the grand slam record, but will France or UK or USA let him in without being vaccinated?
I’m betting on a fake vaccine record compliments of his home country.
Wouldn’t surprise me. The president of Serbia has his shorts in a knot over this:
In Serbia, President Aleksandar Vucic said the hearing was “a farce with a lot of lies.”
“They think that they humiliated Djokovic with this 10-day harassment, and they actually humiliated themselves. If you said that the one who was not vaccinated has no right to enter, Novak would not come or would be vaccinated,” Vucic told reporters.
He said he told Djokovic after talking to him “that we can’t wait to see him in Serbia, to return to his country, to come where he is always welcome.”
Hey, pal, all the lies came from your favourite comrade No-Vax, who lied about the countries he had recently visited, went around with COVID with reckless disregard for other people’s safety, failed to wear a mask when required, failed to get vaccinated while spouting anti-vax bullshit, and tried to enter Australia in violation of its rules.
The one valid point he has is that the Australian government messed up by granting him a visa and then revoking it. It should never have been granted. But other than that, the fault is almost entirely with No-Vax. He deserves the consequences of his actions.
ETA: Quote is from the CBC story:
Natalie Tran, who is pro-vaccination and pro-science, said this.
Is she right about this being a bad indicator of how a minister can overrule, deport, and detain?
Here is the tweet.
