I should be putting this post in the Pit not here the way I feel right now.
Anyway long story short I offered some comics(18) to a comic company…I graded them and they come out to around $1500(Overstreet) but of course I knew I wouldn’t get that much…they have to make their profit too(fair enough)
I sent in only VERY old comics and in quite good condition considering how old(most from the 50s) they are.
The b**tards just sent me an email saying the comics are there and they are offering me around $60.00 for all 18
Some of the comics they graded at POOR when there is no way… no how they could possibly have graded at less than very good/fine at the VERY least. I have sold hundreds and hundreds of comics online at Ebay and privately and NO one has ever complained about how I graded the comics.
I have scans of these comics(most of them anyway) and looking them over I am more sure than ever I am getting shafted big time
A full half of these comics they are offering less than $1 each for comics that are fifty years old…before you ask these comics are in fine or better condition for the most part. Six of the comics were only 30 years old and are in near mint condition…at least they WERE when I sent them…the damn company is claiming they are only fair condition now.
When I sent them I packed them in a cut down Express mail box with padding on all sides…I have ALOT of experience in shipping items so they get there intact.
Sorry if you read all this hoping for a good sex story…I was tempted to put this in the Pit and add alot fo swearing and whatnot…however as it happens I do have a question.
What are the chances of my getting the same comics I sent into them back if I refuse their offer?
Keep in mind we aren’t talking about a difference of opinion of a half a grade or even a whole grade…I am talking about the difference between a near mint comic and one that is in fair condition…there is NO mistaking the two so I am inclined to believe I am being cheated royally!(EVERY comic I sent to them they “adjusted” the grade)
Do I have any recourse? I am planning on asking for the comics back and if they are NOT the same as the ones I sent in…well I am on several comics boards and MANY other places where I can warn other potential suckers to avoid this company.
If they aren’t offering you a reasonable price, don’t take their offer. Get your comics back and either sell them to another dealer or do it yourself.
If they really rip you off and send you back different comics than you sent them, then call the cops and a lawyer. Have them arrested and sue them in jail.
Absolutely - they should be happy to ship your comics back. Shippnig costs are far lower than lawyers fees, I hear. Especially as you could sue them for the full $1500 value, plus compensation for the distress caused.
Be polite with them, though, to ensure smooth running. Only if you get a refusal for return should you resotr to a firm but still polite postal letter stating the return is required, otherwise you will have to recourse to legal means for their return.
Do note that this is only applicable if you haven’t signed any form of contract with them, which I presume you have not.
AFAIK comic books have little serial numbers on them so if you have it written down somewhere you can say to them “My comic is #whatever so I can prove if its the same one I originally sent you”.
Tommyturtle, I don’t understand why you’re sending material off to a buyer before agreeing on a price. That seems pretty silly. But just tell them you don’t take the deal they’ve offered and they need to return the comics.
We had agreed on a price according to the grades I said they were…I stand by those grades too but once they had the comics in THEIR hands they claimed that the comics were practically worthless.
Keeve
I have approximately 5-6000 comics…most VERY old and the 18 I sent in WAS my small test batch…I deliberately sent in only those comics that were in the very best condition and to have this company claim now that all the comics I sent in were in fair to poor condition is outrageous.
I am just worried they may send them back ruined…since the comics I chose to send them were ones they had NO copies of themselves…hopefully they cannot substitute my copies for theirs but they could just to be pissers scrunch up my comics and claim they got them that way
Man I’m never sending comics in to some company like this again…waaaaaaay too much aggravation
You may want to see if they are a member of the Better Bussiness Bureau. http://www.bbb.org/
In fact you may want to check anyone you sell to, to see if they are listed. Anyways, if you get your books back, you should probably just drop it, and pretend it never happened. If there is a problem and you don’t want to go the police/lawyer route, you may want to report them to the BBB. All the better if they are a member. I can say from personal expierence that the BBB has helped me before. I won’t say who I was dealing with but after months of tech support calls and e-mails that were just dicking me around, one e-mail to the BBB and my problem was (more or less) taken care of, all though they do still have a mark in their file for anyone to see.
