Do I need to fill out the DMV SR1 form sent from my insurance?

Hello everyone,
This is will be my first post!
I found 1 similar post from this forum with a similar problem, some people said file it, some said not.
I recently got rear-ended by someone with no insurance. So I got his contact information, and called my insurance to file a claim. And my insurance forwarded his driver’s license number to DMV to let them check whether or not he has insurance, but DMV only gave the driver’s contact information. Now I receive a DMV SR-1 form from my insurance. It says that if you involved in an accident with property damage over $750, or injuries or deaths, you must file the DMV SR-1 form with 10 days after the accident. I’m not sure I should I fill it out.
Right now, I’m still waiting to hear updates from my insurance, they said they’re trying to contact the driver, and didn’t give me a time frame about when I should hear from them. I have uninsured motorist coverage, but I want to wait for the result of the claim, then take my car to repair because I need to be sure that I don’t need to pay for the $1000 deductible.
So should I fill out the DMV SR-1 form? Am I going to wait forever to hear from my insurance company?

Thanks!

It would help if you told us what state you’re in, assuming the United States part.

DMV SR1, California. Statement of Responsibility form. Read the form, it clearly states the law on it. I’d advise you to follow the letter of that law if you want to remain a licensed driver, or, contact a legal professional if you feel like fighting it.

This is more of an advice question than a factual question, and involves possible legal issues, which makes it better suited to IMHO.

Check with your insurance company. They may file the SR-1 for you, and for all you know maybe they already did. Even if so, they might have sent you the form just because it’s part of the package of forms.
