Yeah, I imagine they do due diligence, just because people won’t watch only because the cases are entertaining. They have to be entertaining AND seem real. 
Of course, the material doesn’t have to be real to seem real, but the producers would want to at least, weed out the type of litigants who’d fake a case and then brag about it to the enquirer.
