I think you are confusing “feeling bad” with “psychological damage”. There’s a huge gulf of a difference, and I would hope you can see the difference without me thinking up some horribly graphic examples.

1. No, I am not.

2. The gulf is not as large as you make out.

3. Which category the example under question lands in is debatable, and may not be a constant across all people.

4. Neither are particularly easy to prove in a court of law, which makes them questionable standards on which to base legislation.
