Does this teacher's lawsuit have merit?

So, while attending a conference in 2015 in Orlando, a Wichita teacher, who is also president of the state of Kansas teacher’s union, was surreptitiously videoed while in a bar speaking in a braggadocious manner of what a badass he is with his students.

Now, Wentz has filed a lawsuit against Veritas and Breitbart claiming the video has damaged his career and reputation, and that it is taken out of context and heavily edited.

He is suing for punitive damages and any money Project Veritas made off of the video.

What’s your opinion?

I take it as a given that anything Breitbart does is sleazy and any action against them has merit.

What he’s describing in the video is not “abusing children,” so wouldn’t that be a case for libel? Not that I think it’s behavior exemplary of a good teacher. Or a mature human being.

I automatically assume that anything put out by Project Veritas has been edited to look bad.

Florida apparently is a two party consent state so recording him without his consent was not legal. So it seems the teacher has a case.

That said I am not sure that lack of consent of one party should turn any true, unedited recording magically into libel. Libel or slander, no.

Breach of privacy, maybe. But how much privacy can someone reasonably expect while talking shit in a bar? His own bragging is what caused any damage to his career and reputation, not lack of consent while recording his verbal pronouncements in a bar.

So if Project Veritas can show that the video was a true representation of what he actually said then I think they have a good defense. If they edited it so heavily as to create a product that does not fairly represent what he said then they should be held liable for damages.

And James O’Keefe and Project Veritas are even lower down in the sewer.

And using their history as a guide, your assumption is completely justified.

Many people have no idea how low:

Your 3rd paragraph is more accurate than your first; Florida’s laws regarding this are, um, nuanced. Cite

Also:

O’Keefe is a piece of shit, no question. According to a memo I received at work, his latest project has been to run around trying to discredit domestic violence and sexual assault organizations like mine so that they can manufacture enough outrage to pull Victims of Crime Act funding. I mean, seriously fuck this guy. I hope he’s doing something illegal and it gets him nailed to the wall.

It wouldn’t be the first time he’s done something illegal and got caught. Read thru his wikipedia page, and you’ll notice that almost everything he’s ever done has had some aspect of criminality to it.
