Dog Bite....Whose responsible?

Ok, so here’s what happened. I took my dog Odin to the dog park Saturday around 6:30 in the morning. Around 6:50 enters a dog and his owner. The dogs were running around, everything was going well. Then I noticed that the other dog, Jefferey, growled at Odin. So I called Odin to come to me. Jeffery’s owner, Andy, said nothing to Jeffery and told me don’t worry, he just does that to warn dogs to back off but he doesn’t bite and something along the line that this is how dogs learn to stop bothering other dogs. A couple of minutes later Jeffery growled at Odin again, so again I became worried and called Odin over to me and he came. Again Jeffery’s owner did nothing about the growling. A couple of minutes go by and nothing bad happens both dogs are having fun. I threw a tennis ball for Odin, but both dogs chased after it. I heard Jeffery growling when they were a couple of meters from Andy and I. When Odin came running back to me I noticed blood all over his neck. I freaked out. I gave Andy my cell number b/c I didn’t have my cell to take down his. He said he will call me later in the day so I can tell him how Odin was feeling.

I tried as quickly as possible to get Odin out of the park and when we finally got to my car. I can see the extent of his injury. I provided a link below hopefully it works. Also if you get easily sickened by the sight of blood don’t click on it.

About an inch of his ear is completely ripped off. What made matters worse is that I didn’t have my wallet on me (I know, I know; that means I didn’t have my license). I had to drive home first get my wallet, pick up my sister, then drive to the emergency vet clinic. It took a little less than an hour to do that, during that time Odin kept bleeding like crazy.

The emergency vet clinic bill was $191.70. My sister kept telling me that Andy was never going to call back but he did and he left a voice mail with his cell number asking me to call him back. I called him back immediately and brought up the vet bill. I told him that I felt he should be responsible for it, which was sooo freaking awkward to say to a grown adult. He felt the same way. We met up later that day I gave him a copy of the bill and he gave me a check for $191.70. He was soo nice he felt really bad and he actually called me back. I think a lot of people in that situation wouldn’t have done the same. On top of that he bought two dog toys for Odin. But the situation doesn’t end there, I wish it did.

On the discharge letter from the emergency vet clinic it states that Odin must be taken to his reg. vet to have bandages changed, and wound checked out. I did not realize it stated this until after I came home from meeting Andy for the check.

So I took Odin to the vet this morning (Tuesday). The good news is that the bite is not infected. He got his bandaged changed. He was also given medication to prevent infection and medication for the pain. This vet visit cost me $135.00. In addition to this cost, I have to come back in 4 days to get bandaged change. Also the doc. said that ear wounds take a long time to heal, it could be up to two months so I"m pretty sure I"ll be having at the very least 3 more visits to the vet. With a minimum cost of $50 for each visit.

Idk what to do. On some level I feel bad for calling Andy and asking him for pay up b/c on some level I feel responsible. I saw how his dog reacted to Odin being near him. And instead of listening to my instincts I trusted what Andy said. But at the same time his dog bit off a chunk of Odin’s ear. Odin is in pain and he has to have is activity limited and wear that annoying Elizabeth collar until his ear heals. In addition to that, the dog park we were at states in its rules that: “Dog owners are liable for any injuries or damage caused by their dogs”

So should I pay for any of this? How should I go about talking to Andy what should I say to him? What do you think is the right thing to do?

I can see why you’re torn. It would seem like you’re “padding” the bill from his perspective. It is his responsibility though, and if you push the matter you’ll win. It all depends on how you feel personally about it. I can also see the point of view you have, where you feel partly responsible for what happened.

Is there signage at the park regarding behavior and responsibility?

Yes and it states exactly this (these are only some of the rules on the sign): No aggressive dog behavior.
No female dogs in heat.
Hours of the dog exercise area are the same as the hours for the remainder of the park.
Dog owners are liable for any injuries or damage caused by their dogs.
Users of the dog exercise area do so at their own risk.

Well, as per the signage, the other dog’s owner foots your vet bills. Have you asked to see a rabies certificate?

Call Andy and tell him how much you appreciate him paying the vet bill. Tell him that you didn’t realize there would be extensive follow up appointments/bills. Ask him if it would be okay to have your vet bill him directly for any additional bills.

He will be able to see that you aren’t padding it if the bills come directly from the vet.

It sounds to me like you’re dealing with a stand up guy here. Not only did he call you back but he handed out a check AND bought little Odin two new toys.

Also, he’s a pet owner. I’m sure he’s no stranger to how vet bills work. Just give him a call.

I don’t know what you financial situation is, but if it were me, I’d offer to let him make payments if it’s too much of a burden. (That’s not something I’d normally do for people but this guy seems pretty nice.)

I did ask Andy if his dog is updated on his shots and he told me yes. I believe him.

Just curious. Nowhere in your story do you say that anyone saw Jeffery bite Odin. Are you 100% sure it was Jeffery? In a dog park I would expect lots of other dogs to be around.

@shakes; yes he is a really nice guy. And I would like to contribute to the cost of the vet bills. I just moved out of my parents house. I’m 21 years old. I set aside 500 for emergency vet bills for Odin when I was making my budget to move out. But Idk how to go about this. Idk how many more appts. he needs to go to. Idk what the total cost of this would be. Maybe I can ask him to pay 65% of each bill from this point on. Trust me if I had the money I would have just left it at him paying me to the emergency vet bill.

@cooking with gas; we were the only two owners at the dog park, therefore they were the only two dogs. So I really do believe it was Jeffery who bit off Odin’s ear. But I guess it possible that odin could have somehow gotten caught on something. Though the only thing they were near was a tree. But the wound seems like it was bitten off.

His dog did the damage, he owes the bill. OTOH, the park is “use at your own risk” and you didn’t do everything you could to prevent the incident.

I think I’d talk to Jeffrey’s owner and explain the situation and offer to split the bills, if you can afford it. Or have him billed directly, if that’s what he’d rather.

It kinda depends on his situation, too. There’ve been times when I’d have struggled to pay those bills and been rather upset by the seemingly never-ending outflow for someone else’s dog. But at the moment I’m a lot better set than someone starting out and I wouldn’t want you to screw yourself up when I could afford the vet bills (even if it hurts a bit).

But biweekly $50 visits just to change bandages seems a bit extreme. I’m pretty sure my vet would have sent me home with bandages and whatnot and told me to come back in a month or sooner if there were problems.

So you might also talk to the vet’s office. Some vets just automatically figure you have bottomless pockets and want them to do every little thing. If you explain that you can’t afford all that, they may give you some options there, too.

I agree that while it would be an uncomfortable situation to discuss, I’d explain. I’m sure he understands it isn’t a one time fee if your dog’s ear gets Mike Tyson’ed.

I do wonder though, if he might have some issues controlling is dog. My dog trainer loves the dog park as a tool to train dogs, but she’s absolutely insistent that there should be absolutely, positively, no signs of aggression. No growling. No fixating. Ears and tails in happy places. Even a hint of that needs to be corrected immediately, according to her (and she specializes in fearful and aggressive dogs).

@redtail23: I wish it was $50.00. $50.00 is the fee for making the appointment/exam fee. $44.00 is the fee for changing bandages. So having bandages changed would roughly cost $94.00. Most vets in the area I live in charge $100 just to bring your pet in for a basic exam. Any extra services are added to that. When I was looking for vets to take Odin for his bandage change I didn’t go the vet my parents usually go to. I shopped around. This vet is insanely kind. Her office usually charges new patients $65.00. I told her that I don’t have that much money. So she gave me a discount; she charged me $45.00 for the vet exam, 44 for bandages. 30 for amox pills. (reg price 45) and she charged me 15 for pain killers which is the price for a 2 weeks supply, but she gave me a full months supply. So I will definitely try to explain to her that I might skip the next appointment. and change bandages myself. I have tried changing the bandage before this appt. It was freaking hard. It kept falling off. I ended just taping his hold head with duck tape.

@DiosaBellissima: Yea I do think Jeffery has aggression problems. Odin didn’t growl once at him. But to Andy’s defense he seemed really shocked that Jeffrey attacked Odin. I don’t think his dog has ever done something like this before.

Poor Odin! I don’t know how big Jeffery was, but he’s a big boy. I wouldn’t try and steal his toy!

Even if you do ask the other dog’s owner to pay you back, try to mitigate the cost as if you were paying the bill.

For instance, I’d ask the vet tech to show you how to change the bandage yourself, and what to look for (e.g. if shouldn’t stink). Or ask them to waive/reduce the office visit charge because he doesn’t need to have a full examination each time he comes in for a dressing change. It’s possible the tech can do this for a minimal charge, but they probably won’t unless you ask.

IANAL but I think he’s responsible for all the bills. You could be nice and pay some of the damages since I think you were unwise to play ball in the vicinity of Jeffrey once you saw that he was aggressive. Also Jeffrey shouldn’t be allowed back in that park.

@bobkitty. No, I am so sorry to say I’m not. The emergency vet clinic did a good job bandaging his whole head. But by Monday morning it was loose. Later in the morning he kept shaking his head so violently that the bandage they put on fell backwards exposing his torn ear. Then he couldn’t stop shaking his whole head causing blood to come back out. I grabbed Neosporin put some on his ear. Wrapped gauze around the wound. Then i wrapped some medical cloth (idk) what its called. And tapped all that with medical tape. 20 minutes later he started shaking his head violently again and the bandage came off exposing the ear. He kept shaking his head leaving blood on the kitchen ceiling and floor. So I put Neosporin and guaze but this time i had to use something stronger than the medical tape so I went and grabbed Duck Tape (brand name). I actually dont’ know what kind of tape it was. It wasn’t masking tape or medical thats all i know. And that kept the bandage one until my vet appt. THis morning. So I cant try to lessen the cost and do the bandaging myself or pay $90.00 to go to the vet to get it changed. She didn’t let me watch her tape Odin’s head. So I’m not joking. I did what I could do at the moment.

The other own is 100% responsible for the bite. That’s the way it is with dogs. It’s like rear ending someone in a car.

However, you probably made a mistake by giving him a “bill” before you had all the information. By making that mistake you are probably in a position where he could reasonably fight you on the rest of it and it might be fair to split the difference on that.

@tripolar: I completely agree. It was a stupid ass mistake to just stay in the park when Jeffery was there knowing that he growled at Odin.

@PunditLisa: I will definitely try that. I’m going to call her tomorrow morning to try to work something out.

When my dog had an ear wound, the vet sent a tranquilizer, Acepromazine, for the first few days. It chilled out the dog and as a side effect it lowers blood pressure, thereby helping with and seeping/bleeding. And it was cheap.
