The evidence that they found could have occurred due to rape or could have occurred due to consensual sex. On its own it was not probative of anything; only seen with other evidence did it have real value.
That’s definitely not how it was presented a few days ago. It was stated as a definite proof forceful sex had happened, not could be either rape or “bit’ rough” consensual sex.
I assume, like you, that it wasnt the diamond hard proof that it was first presented as. Otherwise, it would make little sense to abandon the prosecution at this stage.
My guess is that there was no rape. Based on the following.
The accuser’s story - that DSK rushed naked out of a bathroom and attacked her - seems bizarre. Even if we grant that the other accusation against him is true, there’s a big gap between getting persistent to the point of force and just charging out naked, before even realizing who was in the room and whether it was someone he’s even be interested in assaulting to begin with. (For all he knew, it could have been a man or an extremely unattractive woman - or several people.)
As has been discussed previously, the accuser is 30 years younger than DSK, and bigger in size, and DSK had no weapon. People have claimed that it’s possible to rape someone in this situation, and that’s possibly true, but it does not make the story more likely, if there’s some doubt.
You can quibble with each piece individually, but if you add it all up, you have what seems like an inherently unlikely story being backed with virtually zero evidence, and IMHO the best guess is that it never happened.
I think this woman saw a potential jackpot-and decided to make up the story. The old geezer is not a sympathetic character-but she clearly thought that this was her ticket to riches.
She’s close to 6 feet tall and has at least 30 lbs on him, and does hard physical labor all day. That a relatively small man in his mid 60’s is going to be manhandling her into sodomizing him is, IMO, a bit of stretch.
My guess is he saw her, she’s actually quite curvy, decided to take a chance and propositioned her for a blow job. She initially complied, but then *something *happened. Maybe he was too rough, she didn’t get paid, there was a disagreement over money, maybe he insulted her or she changed her mind … who knows. IIRC at no point did DSKs people say anything about him paying her, and I’m guessing that maids aren’t wandering around offering up blow jobs for free so I’m guessing she was VERY pissed about the way it transpired and decided to drop a dime on him.
Or (more likely, IMHO) as she herself said “don’t worry, I know what I’m doing, he’s very rich”.
People like to portray lower class immigrants (especially females) in these situations as naive innocents, but this is bogus. A lot of immigrants have just as high IQs as anyone else, and IME most immigrants are very well aware of America the Land of Lawsuit Opportunity.
My guess is that he gave her a few bucks and she saw an opportunity to make quite a lot more.
She has been very quick on the trigger WRT lawsuits in general. She undercut her own chances in the criminal trial by filing a civil lawsuit too soon, and she was very quick to sue the NY Post for reporting that she is a part time hooker. IIRC she is also suing someone in France for allegedly paying off potential witnesses.
IMO people overestimate the power of these “powerful” people. They have certain power in certain areas and situations. But they are also ripe for victimization in some ways, most notably in that they are lawsuit magnets for fast-buck opportunists. If DSK would not be who he was, he would probably not have gone through any of this.
The most likely scenario, given what we know of both their characters, is that he paid her for sex, and she wanted more money, and claimed it was rape.
