Good question. In the past, I would have suggested they brought such a ridiculous case in order to curry political favor. But with the Supreme Court as it is, maybe they had a shot of getting something through.
The Missouri AG brought it under the Supreme Court’s original jurisdiction, as one state suing another. Their argument was that the NY prosecution impaired the right of Missouri citizens to bow down and worship at the feet of the Orange God attend one of Trump’s rallies and take in the reasoned political discourse, essential to being able to cast a fully informed ballot.
If I recall correctly, the Texas AG tried something similar to try to challenge the 2020 election results in some of the other states, using the Supreme Court’s original jurisdiction. Supreme Court kicked them to the curb.
What’s the procedure if someone dies before the election but after sending in a mail in ballot?
I googled, and will share below. Georgia doesn’t have a rule one way or the other, apparently.
Some states are silent on this issue. Others address it directly in statute, either by prohibiting or permitting the counting of ballots from voters who die before Election Day.
Nine states—Arkansas, Florida, Hawaii, Maryland, Massachusetts, Montana, North Dakota, Tennessee and Virginia—have statutes that explicitly permit counting absentee ballots cast by voters who die before Election Day; one state—Connecticut—only counts these ballots if the deceased voter is a member of the armed services.
Ten states—Delaware, Illinois, Indiana, Iowa, Missouri, New Hampshire, New Jersey, Pennsylvania, South Dakota and Wisconsin— have statutes that explicitly prohibit counting absentee ballots cast by voters who die before Election Day. Missouri states that such ballots be rejected only if sufficient evidence is shown to an election authority that the voter has died before the opening of the polls on Election Day, and the deceased voter’s ballot is still sealed in the ballot envelope.
At least two states—Kentucky and Mississippi—also prohibit counting deceased voters’ ballots, but through attorneys general opinions, rather than statute.
In the remaining 28 states, NCSL has not found citations indicating whether absentee/mail ballots from voters who die before Election Day are to be counted.
As a practical matter, it is hard to retrieve ballots from people who have died between casting their votes and Election Day. Once the absentee ballot has been verified and removed from the envelope for counting, the ballot cannot be retraced to the voter.
Given how many times Trump has said Harris is getting the nomination unconstitutionally it’s clear that he doesn’t understand what the nomination process is. And that he hasn’t read the constitution.

Trump, can you please stop pretending you don’t know what Project 2025 is? All of your people are in on it so if you truly don’t know what it is you are openly admitting that your people are actively betraying you before you even get started. In the Xwitterverse, there’s a concern that Jamie Raskin is going to overturn the election results. Of course, I’m sure it’s mostly bullshit. But I can’t find anything that Raskin has said recently about the upcoming election that could be misconstrued into what the MAGA crowd is saying.
