What do you think about C1 and C2? Did what Elizabeth Prelogar said yesterday make sense where it covers peaceful protests? How about a ‘break in corruptly mens rea’; I was trying to understand how this applies to the January 6th Obstruction (like whether it had the nexis for the argument to apply). I would clearly have to look it up in legal databases too.
I am of the viewpoint that using Sarbannes-Oxley to prosecute rioters who were trying to interrupt a vote-count in Congress is rather a long stretch of what SarbOx was meant to deal with - namely, financial crimes in Wall Street or Enron-type scandals.

Thanks Comma Sense for the article. It was a good description of what the justices asked about yesterday. Fischer cheered and went into the Capitol for four minutes after they’d broken. He apparently wasn’t one of the really violent rioters but he did put himself where he could get arrested with others. Like you and Velocity pointed out, it can be to charge him der the Oxley law.
