forced to use breathalizer at work

[B]unionized enviorment - 3500 workers - I was denied union rep to be present at 8 15 am - went into on work site heath centre till 1145 am - the new breathalizer machine purchased on jan 2 2011 was only a week old on my Friday am blow on device- device failed** to take readings then failed to store readings .062 was loged but lost to the memory device upon uploads and the nurse had to call in 2 more people too help he with the device cause they admitted the were trained - but not good - the nurse must have got a certificate to run it - but never used it till needed 5 days later and they complained about it all the time while I was in there - their supervisor came in and flipped through device flowcharts and instructions and stublled through it for a while also untill the - ( out of 6 readings on 6 different tubes to blow in ) they managed to save the only high .o82 and .088 readings - welcome to the oils sands in fort mcmurray alberta canada - trying to save job - looking for ideas…union pres says likely dismissal but will be on discrimination - as the supervisor has been trying to get me since he became my supervisor - after being my apprentice - now he sells pot on the job site and im the criminal for coming in tired after 17 days of working 12 -14 hr shifts and i blew off some steam on nite - coworkers said noticed nothing funny - no incident - just a supervisor out to make a name for himeself - other than that of a pot dealer.

The night before i drank 9 beer at 4% till midnite and slept from 12 30 to 620 am - drank cofee - missed breaky and made it to work at 8:02 am - a little “unclean shaven”

Yeah, the best thing for you to do right now is just shut your mouth and let your union guy argue it because the post you wrote above is horrible and obviously a lie. No one gets sent to take an alcohol test because they are a little unshaven in Ft McMurray Canada in the middle of winter.

What’s your trade? I agree, let the union take care of it.

I will say, if you cop to alcoholism they may not be able to fire you if you agree to get treatment as it’s considered a health condition. You could check the AADIC website for info.

Have you been warned about lateness/coming to work under the influence before?

ETA - I wouldn’t worry too much about the brethalizer readings - it’s entirely possible that ANY reading above 0 will get you in hot water. Again, depending on your trade your Health and Safety guy would probably shit a brick if you tried to use rigging equipment after drinking.

If you stopped drinking, after 9 beers, at midnight, I fail to see how you could blow a. 088 or. 082 at some point after 8:02 AM. You’re omitting something or not being truthful.

Dude, if you’re blowing those numbers when you show up to work in the morning, you deserve to be fired. NO WAY I would want to trust my life and safety to you.

I conclude you have a drinking problem and should seek help.

The math isn’t working out for me, or maybe it’s the confusing OP.

You quit drinking at Midnight, and were pulled aside when you got to work around 8:00am the next morning. And the company health center tested you at 11:45am.

Almost 12 hours after your last consumption of alcohol. Nine beers, the last one 12 hours ago.

You should have been stone sober by then. Even 8 hours after 9 nine beers should be clean.

.08 is legally drunk in many states.

Legal limit for driving, or a DUI, is generally 0.08. So in otherwords, by almost NOON, he was still legally drunk on the job. Does not compute.

I assume that the numbers given in the OP are percentages. .08% is considered legally drunk in North America from a driving under the influence standpoint.

Based on the time of the OP, as opposed to STILL drunk, I would go for drunk AGAIN.

Ah right, gotcha. That’s the same as the UK, then. So that’s about 1 1/2 or 2 pints of regular beer (20 ounce ones) left in the bloodstream 12 hours after stopping drinking. (rough calculation based on UK drink driving recommendations). What size is beer typically served in Canada, because I doubt nine UK pints would leave you in that state?
