I wonder if he is seriously suggesting that he is going to sue the government for passing a law? That should be fun to follow!
He can challenge the law if any members of his cult are arrested and charged under it. I don’t think he would have standing to sue just because the law was passed.
I know he can challenge the constitutionality (as if I’m not mistaken he is in the process of doing for similar state laws); it’s just the way he phrased the letter makes it sound like he really intends to sue the government for passing a law. His stuff is getting stranger and stranger (apparently some kid got killed recently after getting run over by a Christmas parade float; according to him this is also divine retribution for the “fag-loving” US).
According to him, everything bad that happens in the entire country (and possibly the world) is because the US loves us fags.
I don’t know what the bill says, but presuming were enacted and prohibited protesting at funerals of soldiers, Phelps, as part of a group that regularly protests military funerals, would likely have standing to bring an action to enjoin enforcement of the law as violating his First Amendment rights of free expression.
