WRT this part of the Miranda rights:
“If you cannot afford an attorney, one will be appointed for you before any questioning if you wish”.
Who decides whether I can afford attorney or not? Is my saying I cannot afford a lawyer good enough for them? I ask because I remember reading years ago about someone who was denied a public defender because a judge reviewed the defendants assets and determined he should be able to afford his own lawyer, even if he had to sell his house and his possessions.
