I actually think I’d like to see her just heavily fined. I’m not sure what the parameters are for how much the judge can fine her. At first I wanted to see her locked up for her stupidity and impertinence, but as I mulled on it I realize that this woman is likely going to get rich off of this. She goes to jail for a month, 7-8 weeks or whatever. Kentucky’s government is already moving against her, there’s a civil suit against her brought by Rowan County’s government. Further, there is a potential criminal official misconduct case being brought against her that’s been forwarded to the Attorney General. While the Statehouse itself is lukewarm on going after Davis, if she’s sitting in prison defying a Federal court order then I think there’s a likelihood they move against her and that could ultimately see her stripped of her office as I understand it.
If the appellate court sends her off to jail that just increases her fundraising capacity. I’m assuming that just like Zimmerman was able to raise hundreds of thousands there is already a fund for Davis that will swell ever larger the more trouble she appears to be in. So I’m hoping there is a mechanism by which the judge can fine her so heavily it offsets any income she can derive from this. Further, I hope that since her behavior is misconduct of office there is some mechanism by which Rowan County can have her held personally liable for any damages in lawsuits filed against the county by LGBT persons seeking marriage licenses (or even straight couples, who likewise have been unable to get licenses in Rowan County.)
She makes $80,000 a year doing a job that a monkey could do, largely because it’s elected and she has it because it’s a shit hole county no one wants to live in and where no one else bothers to run for the office. I want to see her lose the job, and also be punished financially to the point of bankruptcy even factoring in all the support she’s going to get from wealthy fundamentalists. That will have far greater lasting punitive effect than some time hanging out in county women’s lockup.
I don’t know. I think sending her to jail might just make her a martyr for some folks. I’d just like to see her removed from her job. Then we just ignore her.
I wonder if there are any state laws that prevent a criminal from making money off their crime? I would love it if she could collect a couple million bucks, which could then be seized and distributed among those she refused services to.
The news article say that the state legislature had the power to remove her. Any idea how consulted a process that could be? And, any assessment of the political will to do so?
IMO this means no punishment at all. She’ll raise enough cash from fundamentalist supporters to pay any conceivable fine. At least jail will get her attention.
Now that I’ve learned that it’s very possible she’s committed a crime, and is continuing to commit them daily, I think it’s important she be charged and convicted.
I believe only the state legislature can do that, by impeaching her. Kentucky has a part-time legislature that is prohibited from sitting after March unless the governor calls a special session.
She’s going to be a martyr for the “traditional marriage” brigade regardless of what happens now. Hell, look at Roy Moore. He was removed from the Alabama Supreme Court for misconduct and overwhelmingly re-elected like four years later.
To be fair, the only one fucking around really seems to be her. We’re all seem to be pretty much agreed that she’s a dipshit and a ne’er-do-well. We just don’t have any authority in Kentucky or Rowan County. It may feel pretty callous to all of the men and women she’s hurt, but I don’t think there’s anything to do but let her keep waving her red cape of assholery in front of the bull of justice.

So please stop saying “fire her”; she can’t be fired, no one has the authority to do that.
It’s the only thing that can be done to remove her from office, which is what Bo was obviously talking about (or would be if you hadn’t snipped out part of his post).
So, and I realize you are not necessarily familiar with Kentucky’s laws and statutes, but if instead of refusing to issue marriage licenses, she had hit her head and were in a coma, Rowan County would be up shit creek re: marriage licenses? Or if she killed a man and was on the lam in the backwoods of KY? There’s no auxiliary process for getting marriage licenses or whatever else the clerk’s office does when the Clerk is incapable of or unwilling to do their job and the legislature is out of session barring a request from the governor?
It would get her the fuck out of the way until she could be fired. I would settle for that, and I’m sure the couple that kept getting refused by her would settle for it.
In fact, I bet they would love to send a large slice of their wedding cake to her holding cell.
