It’s her job, one of the key duties of her position, to issue legal documents, like marriage licenses. The people elected her to provide services to the people of Rowan county, and she’s refusing to provide those services, in direct violation of the rights of people in her county.
Fining her will not work, she’s going to be able to live off the donations that will be pouring in. Ultimately, she has to be relieved of her duties. Perhaps a judge could direct that neighboring counties provide offices in her county to take care of marriage licenses. This cannot be allowed to stand. She put her hand on the Bible to uphold the Constitution, not the other way around.
There is no “customary sentence” for contempt. Contempt is a tool designed to effect compliance with rules and orders of the court, not a punitive measure. It’s not a statutory offense like, say, perjury. The “interested private citizens” are the other parties to the case, so their requests should absolutely be taken into account.
So, I’m just curious. Is it only this issue that has Ms. Davis’s hackles up? What if a group of Jews wants to start a synagogue, or say a group of Muslims wants to start a mosque in her county? Going by her so-called logic, she cannot issue them permits for that because then she’d be agreeing with all of their teachings. What about a restaurant that wants to serve shellfish? What about when someone comes in to apply for a marriage license and that person has been divorced but not for the one stated reason in the New Testament. Oops! I forgot; she doesn’t think that part of the Bible applies.
Look, Kim. You’re not approving or disapproving of anything by issuing a license. You’re not even officiating at the marriage unless you want to and then only if (a) the law permits you to do so, and (b) the applicants request you do so. All you’re doing by issuing a license is certifying to a set of facts; to wit: the applicants meet the requirements under the law to receive said license. Here’s a good example of someone certifying to a fact but without approving of the individual case: I certify you are a hypocrite. I do not approve of you nor of your actions.
Pretty simple. Even a rube like that witch should be able to get it.

So for her, it’s more than just her beliefs. It’s also evangelizing. Let’s hope she gets defeated quite handily in the next election.
She can go evangelize all she wants outside of her responsibilities. But what she is required to do as part of the job she gets paid to do is issue licenses to SS couples.
It seems clear that an earlier poster was correct in saying that she is just trying to expand her celebrity for the lecture circuit or to write a book.
