Nah, I say we should just turn it over to the court system.
It’s a difficult rule to enforce, for sure, but without seeing the posts in question it’s hard to tell what’s going on. One might simplistically think “well, facts are facts, right?” but it’s not always that clear cut and it’s not always apparent when someone is deliberately posting factually incorrect stuff.
Still, the rule is there, contrary to the claim made that it isn’t.
He made up a descriptor, which he believes is accurate. It’s not out of the realm of possibilities, so the idea that this was posting stuff known to be untrue is nonsense.
Keep in mind that “knowingly posting stuff that is not true” is a very difficult rule to enforce. I think I’ve usually seen it enforced along with “being a jerk” or 'hijacking a thread" or the like. But it has been enforced.
