Also I have a vague recall of the early admin cracking down on mail order Cigarette sales from indian rezervations. Can’t find anything on google though, so maybe I’m misremembering.
And of course, I imagine the Stimulus and Obamacare will have/have had a big impact, though obviously those aren’t targeted specifically at Native Americans.
My general understanding is that there cannot be any legislation that impacts natives because most groups/tribes have a sovereign nation treaty with the US.
Basically that means that US laws don’t apply to Native American reservations.
In order to impact a certain tribe/reservation, the gov’t would have to draw up a new treaty or sovereignty agreement which the tribe would also have to sign.
Since the tribes/reservations/treaties were established, no president or legislative body has enacted anything because they can’t.
That’s a common misconception, but it’s incorrect. Reservations have a degree of autonomy but they are created by federal statute and classified as “domestic dependent nations.” They are subject to federal law, which defines their relationship to the federal government and the states. All of this stuff (which can get really complicated and technical) is managed by the Bureau of Indian Affairs.
This is also incorrect. Nearly all currently existing reservations are organized under the Indian Reorganization Act of 1934, which reformed and replaced a patchwork of federal legislation and intergovernmental compacts dating back to the Dawes Act and before. This act allowed tribes to set up devolved governments with a large degree of autonomy, similar to other federal territories. That act can be (and has been) amended by Congress, and regulations pursuant to that legislation are promulgated by the BIA. Tribal citizens are entitled to representation in Congress, and to lobby the BIA and Department of the Interior to express their concerns.
Ack - that should say “entitled to lobby Congress.” Not all tribal people live on reservations with Congressional representation.
