I wouldn’t look towards the criminal intent because of action. I’d look at the criminal intent based upon INACTION.
Inaction that the school district knew there was the potential for this type of situation and did nothing to circumvent it. Inaction in that the pictures were captured and stored on computer systems without the school district having any plan to eliminate them once it was determined nothing illegal was occurring. Inaction in that, whoever reviewed the pictures did nothing to address the issue of children having their pictures taken in various states of undress inside their own homes.
Intent can go beyond sweaty old men on a school board rubbing their hands together in glee cackling “finally now we get to have pictures of naked children and no one will be the wiser!”
They didn’t intend to spy on the kids? What, it happened by magic? Of course they intended to spy. Perhaps they did not intend to offend anyone. Perhaps they did not realize that what they did was a big no-no. But yes, they intended to spy.
Is this the future of voyeur? I know there are ways to hijack a computer and basically have free reign of the entire system including the webcam. I guess then you could simply record it all on your computer for review later. Sometimes I leave my laptop open when I’m getting dressed or coming out of shower. Of course I’m hideous so NO ONE would be interested in my live feed…but what about the countless high school and college girls that have webcams?
I’m going to put some electrical tape over my laptop’s webcam right now. Ew.
To be fair, mom hasn’t been a college or high school girl in…well, I wouldn’t actually survive typing an actual number. Her dinosaur-riding peers would kill me long before I got that far.
