How do I sue these jackass telemarketers?

So I’ve been inundated with telemarketing calls from some jackass mortgage company “Hi guys, this is Suzie from Mortgage Solutions…”.

Grievances:

  1. It’s a recorded telemarketing call, which I understand in and of itself is illegal.
  2. I’m on the Do Not Call list
  3. The calls are to my cell phone
  4. When the recording says “press 1 for a live person”, it either simply disconnects you or you do get a person who won’t answer any questions.
  5. I get several of these annoying calls per week, from a couple different numbers – all the same area code, though
    According to this guy (Telephone Consumer Protection Act & Other Telemarketing Laws) it is entirely possible to sue telemarketers with a rather minimal amount of effort and cost. He provides some good information on what you’ll need. I’ve kept a log of all the calls w/ times and I’ve got copies of my phone records showing these calls, but my question is how do I actually go about suing them when I can’t even figure out what the company is or who I’m suing?

Suggestions? While I really just want the calls to stop, I wouldn’t mind making these guys pay.

Do you mean that your cell # is on the DNC list? You personally are not on the DNC list, only registered phone numbers. I ask because if only your home phone is on the list, that does not extend to your cell.

If you believe that the do not call law has been violated, you can file a complaint at www.donotcall.gov They can process a complaint with a phone # even if you don’t have the companies name.
