I KNEW there was a reason to buy the Witkin set! YAHOO!

(Warning: This is a Stoid’s Legal Hell Update. You probably don’t wanna know. And I ain’t gonna 'splain it. The goddamn pit threads got a bazillion views already, if you really need to know, you can go there. But I ain’t gonna. Getting bashed in the courts is plenty.)

I picked up Witkin’s Civil Procedure, all 10 voumes, 2007 supplements, and the complete Witkin Index for only $50 last week. that’s like…free. I just love Witkin and unlike a lot of other treatises and practice guides, it’s hardbound so copying it is a bitch.

So I sat down to read the Appeal section from beginning to end. And the book fell open to EXACTLY THE PAGE I needed to answer the question that I cannot seem to get ANY answer to anywhere else. My friendly lawyers didn’t know, and the experts that I don’t know wouldn’t entertain the question to begin with. (Talked to a partner in a high powered appellate firm yesterday, nice guy, nice chat…and $3000 for the pre-consultation reading of my two writ pretitions and related material and two hours of consultation. Umm. Thanks anyway… Actually, he did refer me to a lawyer who was a research attorney for the appeals court for a couple of years and a former partner in his firm. I’m still going to call, ya never know.)

I’m not kidding. It was exactly what I was looking for, and then today, I found part two of the same thing. (I KNEW there would be at least one case involving a bunny with a pancake on its head!)

And of course, now I’m tracking down the cases Witkin cites on both parts, because while this does address the bunny and the pancake on its head, there’s still a cloud around how it got there, but I’m way closer.

But I’m jazzed. And a little bit…well, let’s say I always appreciate it when the Universe seems to have a hand in things.

Well helll I forgot the best part: so far, all the material I’m finding is completely supporting my point of view regarding bunnies and pancakes, which had been based on both reading of the law and practice guides, as well as common sense. Nice to know. VERY nice to know, the bunny-pancake question is make or break to my going forward.
