can i submit i-864 for my wife with two years tax return and income? it is 2years since i’m in USA.i came in USA on 2012, so i only have two years tax return and income. i have a joint sponsor who meets all the requirements. so can i submit affidavit of support for my wife now?please help
Consult a tax expert who has experience with your kind of situations. Depending upon the advice of strangers can lead to problems, and messing with the IRS is usually not a good idea.
i’m not messing with IRS, neither i will ever. but for my current situation is it possible to submit the documents for my spouse?
It’s not the IRS, it’s the fine folks over at Immigration.
The advice is still the same though - consult a lawyer
The answer depends on many things - most notably what kind of visa the OP has H1B, L1 etc. Some visa are non-immigrant, some are, some allow you to bring your spouse over, some don’t.
If you get your advice over the internet from random strangers and then submit it to the USCIS, you’ll be in a bit situation very quickly. Trust me on this.
i am trying to bring her as an immigrant. i’m really confused now what to do, consulting a lawyer gonna make the processing delayed, i’m so so confused now
Hang in there; whether your question is primarily about tax law or immigration law (or some combination of the two), we have experts here who can point you toward the correct professional assistance. One or more of them should be along eventually.
However, to maximize the chance of that happening, it would be helpful if your thread title specified which area of law you’re wondering about. If you’d be good enough to specify that here, I’ll be happy to contact a moderator to have the title changed.
Or you could contact the mods yourself; report your own post using the red triangle, and write a message asking that the title be changed to attract the attention of the kind of expert you’re looking for.
Welcome to the USA, welcome to the SDMB, and good luck! :),
An immigration lawyer’s job is to make the whole process less confusing, especially in situations like yours.
What kind of visa do you have, or is it a Green Card?
Did you get married before or after you obtained the visa?
In general, if you have a Green Card and you are applying for a K1 visa, and your joint sponsor has the correct paperwork, then you should be able to file, but it is much easier and much much quicker, to consult a lawyer.
i am a green card holder, i married after i got my green card

While there are some factual aspects to this, the overall issue is one of advice and involves legal issues as well. This makes the thread better suited to IMHO.
Thread title also changed to better indicate topic.
Moving thread from General Questions to In My Humble Opinion.
Getting married abroad after getting your Green Card raises alarm bells inside the USCIS.
Your choices are
-
file the i-864 and all the other paperwork without seeing a lawyer. You might get lucky, but there is a 50/50 chance the visa will be delayed or even refused. Be prepared to wait at least a year before seeing your wife again
-
Consult a lawyer and let her handle paperwork. Your wife will probably be in the US within eight months.
When I married a US citizen, I chose option 2!
You can only file an I-864 if you filed a federal return during each of the past three years (though you only need to attach the return for the most recent year.)
*I am not a lawyer. I am not an immigration expert. This may be entirely wrong, and probably is. Proceed at your own risk. *
Good luck.
