IIRC there was an episode of DS9 where it mentioned as no longer illegal after the Federation-Romulan alliance was formed. I always supposed that it was illegal because of a trade embargo, like Cuban cigars, and not because it’s worse than other beers.

In an outtake scene from Star Trek: Nemesis, IIRC, Worf complains about his hangover from too much Romulan ale.

Worf: “It should be illegal!”
LaForge: “It is illegal.”
Worf (groans): “Then it should be more illegal.”
