What I fear here – and I think ICE probably knows this – is that more often than not, a person who may not have legal standing to be in the country, notwithstanding the fact that there was a Fourth Amendment violation by ICE, may ultimately be out of luck. You could say that the arrest was illegal, and you go back to square one, but at the same time you’ve apprehended the person. So I’m struggling to figure out how you remedy this.
You put the person who violated someone’s rights into jail.
If we ever, ever, ever, did a little more of that cops wouldn’t maybe be so cavalier about other people’s rights. As it is, the remedy is to put the wronged person back where they were and slink away silently.
The Justice Department today announced that William Dukes, Jr., a former sergeant with the Providence, Kentucky, Police Department, was found guilty Friday in federal court on one count of willfully arresting a citizen without probable cause.
After five days of trial, the jury convicted Dukes of arresting the victim, knowing that he did not have probable cause to believe that the victim had committed a crime, in violation of his 4th Amendment rights.
That’s what it looks like when the DOJ isn’t complicit in the crime to begin with.
As long as they’re only confiscating guns from brown people, they’re cool with it.
Same with Stand Your Ground or Castle Doctrine states; those rights only extend to Trump voters. Anyone one using a Second Amendment Solution against a warrantless home invasion by masked thugs will spend life in prison, if they survive.
Eh, the gun rights lobbies did not like it when Trump was trying to deny guns to trans people.
I don’t think they’d like the idea of taking guns away from brown people either if it ever becomes a loud issue. That really is a line they don’t want to cross. It’s almost refreshing how their gun worship can transcend other political issues for a certain demographic.
Until ICE agents start going to prison for violations of people’s constitutional rights this isn’t going to stop and it’s only going to escalate. Hold them accountable. Unlikely to happen while we have a self described dictator occupying the White House and Bondi in charge at the DOJ and Noem cosplaying all over the country. The ‘South is rising’ again folks.
ICE should just go back to their traditional garb of white sheets and hoods. Truth in advertising and all that. When the dictator pardoned all the January 6’ers last year they heard the barely veiled dog whistle loud and clear. That’s why we have federal agents arresting five and ten year olds in subzero temperatures and shooting innocent people in the face.
What I’m saying is that there will be no revolt. The ACLU will fight in court, thankfully, there may be protests when the weather is nice or the scheduling is not inconvenient, but no revolt of any kind.
American exceptionalism is real: We are exceptional in our capacity for selfishness and apathy.
Most of us here pretty much agree, but it ain’t like that “out there”.
Outrage out there really seems few and far between to me.
ICE is beyond redemption. Every single person in the agency should be tried, convicted, and sent to Gitmo forever. What’s even worse than ICE are the MAGA cultists who are fully on board with the ICE terrorists. It’s sad to see that so many of our fellow citizens are evil shitbags. I don’t even know where to begin to punish Kristi Noem. Maybe she should be tied to a chair and forced to watch brown children play with puppies.
That is exactly where you’re at now. This is a tipping point. Either the public rises up NOW and does something about it, or you accept that you live in a fully controlled fascist state.
I’m betting it’s the second. The vast majority either want it, are totally unaware, or just don’t give enough of a shit as long as they have a show to watch and potato chips to eat.

Two women detained by ICE save agents life when he suffers a series of seizures. After he is revived, other agents put them back in handcuffs and take them to detention. They were allowed to call their attorney, who called their state representative to intercede on their behalf.
