I was handed this link from a person of questionable gullibility but, I just want to make sure that I am not missing anything. The idea is that if you copyright your name than according to the UCC you can file against your creditors, police or anyone using your copyrighted name to generate income. Nice idea, I can’t see it working in reality. The website itself sets off all the crap detectors I have, not to mention that it directly links to sites that confirm the existence of UFOs and ghosts. Has anyone heard of this before?
It is total baloney. To say a person would have to be gullible is an understatement. The are con artists out there always looking for something new to sell to suckers. This is a recent variation of a very old theme.
Even if a person’s name could be copyrighted, there is still the concept of “fair use”. Creditors, police, etc. would obviously be entitled to fair use. You could only go after people making money off of using your name (which you can do without copyrights anyway: they’re called “trademarks”).
IIRC you can send a creditor a certified letter telling them not to contact you and you could sue if they violate it (except to sue you to collect their money).
This dodge has never been upheld in any court of law that I can find. It seems to fall under the same category of the claim that “there is no statute saying you must pay income taxes”.
Not true. An original creditor can contact you for the purposes of collecting a past due debt, even many times a day, without fear of reprisal. The Fair Debt Collection Practices Act, which applies to secondary colletors only, does allow for limiting the kinds of contact that can be used. You can read it here.
