Insurance Problems

Long story short:

Got rearended on July 4th by a woman driving her brothers car. Simple rearender, I was sitting at a light, she hit me, no other cars involved, no witnesses, crack in my bumper. Brother’s insurance is the same as mine, they still haven’t settled. Is the insurance just giving me the run around because they don’t want to pay up? How long can this go on? I mean, I don’t want to have to get a bumper for a $600 bumper, but I leave for school in a month.

Also, the womans personal insurance is secondary to the car she was driving, at what point should i persue payment from her insurance if the brothers insurance doesn’t come through. Sorry if this is all kind of confusing.

Did you file with your own insurance company? I think they should be dealing with the matter. But maybe it depends on which state you are in (assuming the U.S.).

Yes, I did. My insurance company is the same as his insurance company. I have Mercury Insurance and so does he, and that’s why I think the insurance may be delaying things on purpose. It should be a very standard rear-end case.

Do you have an insurance agent or do you have a direct relationship with the company? If you have an agent, he/she should be on the phone to the company on your behalf to get your money. That’s what they get paid a commission for. If you have a direct relationship with the company (like a GEICO type company) you’ll have to do it yourself. Assuming you’ve gotten a couple of estimates and sent those in, and have already inquired about the status of your claim, I’d start raising hell. With both vehicles insured by the same company there’s no excuse for that kind of delay.

The company should pay the claim and if they decide to go after the woman’s own carrier, that should be done after the claim is settled and you should not be involved in that.
