Is it illegal for minors to possess beer cans?

There is a person on my local Craig’s List giving away antique beer cans, with the caveat that you must be 21 to receive them. Are empty cans really a controlled substance?

It might be than they aren’t empty. Unopened antique cans will almost always be worth more than empties.

I would imagine that, in some cases, it could be considered prima facie evidence that the minor had once been in possession of alcohol. Clean, empty antique beer cans, probably not. Still-fragrant empties in a back seat, probably so.

It has to be because they have beer in them yet.

It doesn’t have to be. It could easily be because the person doesn’t know the law, except that there’s something in it about minors and beer, and doesn’t want to be bothered to check it out. In fact, I’d say that’s by far the most likely explanation.

Seriously. Craigslist isn’t a legal authority of anything. That’s the seller’s CYA disclaimer.

Besides, most people who collect this sort of thing are likely older anyway. The seller just wanted to make it clear that the posting could not possibly be construed as even toeing the line of legality (to avoid deletion by the CL mods).

Another reason could be if they’re collectible, they don’t want some kid to crush and recycle them. Let an adult pay through the nose for the privilege!
