Is this company breaking the "Do Not Call" Telemarketer law?

According to the Federal “Do Not Call” list regulations, a company may not call you if your name is on the “Do Not Call” list unless:[ul]
[li]You have done previous business with the company[/li][li]It is a survey[/li][li]It is a campaign solicitation[/li][/ul]
My wife received a call today from a company called, “CrystalVision” that claimed to be, “in partnership with Broderbund”. They wanted her to buy for $19.99 a one month membership to their shopping site that would allow her to buy software and printer products at reduced prices.

She knew it was a scam and my checking later confirmed it was a scam.

My question to you is, did they violate the “Do Not Call” list regulations? I’ve never done business with CrystalVision, though we have bought a product from Broderbund, but I don’t think that gives them the legal right to call and solicit us on the phone.

So do you think they are breaking the Do Not Call law?

It sounds like it, unless they’re able to claim thast they were trying to contact the missus and she had some relationship with the company. The thing to remember about shady telemarketing outfits is that they don’t expect to be in business in 6 months, anyway. They’ll have closed up shop by then and started a new telemarketing scam.

Did you buy your Broderbund product online? Did the retailer have a checklist that included permission to share your information with their “partners,” or ask if you would be interested in similar offers,etc.? If you neglected to say “no” to these questions (the default is usually “yes”), then your info was probably provided to CrystalVision by them, in which case, they are not violating the “do not call” regulations as you presumably asked to be contacted.

And ya know, now that I think about it, I have a question:

Even if it is a company that you have or do do business with, once they do call, must they abide by a request to place my number on the do-not-call list?

One of my credit card companies is getting on my last nerve.

She had bought PrintMaster 16 on DVD data disc online from them. I asked her the same question and she is certain she did not “opt in” during the ordering process and made sure to not have then contact us.

I’m pretty sure Broderbund is one of the companies that asks about “do you want information about offers from us, and our affiliates” [check/uncheck] not when you order, but when you register the products online. I’ve never bought from them online, but I know I was asked those questions, so it must have been for product registration. If you don’t notice where to uncheck, the default is yes.

I won’t discount the possibility that something was missed during the product registration, but my wife is pretty thorough when it comes to things like that.

No. While there may be other remedies, the Do Not Call List regulations specifically exempt them.
