Not in IMHO since it’s not going to court and the situation is resolved.
I get a charge on my card and CapOne (awesome btw) declined it as fraudulent. Investigating, here’s what happened.
Kaspersky, due to its ties with Russia, was banned from the United States so I switched to BitDefender and tried to close my account with Kaspersky. By that time closing my account was impossible as NO transaction could happen on the Kaspersky site. They announce we are bugging out and we are going to give you a deal on switching to Ultra AV. I wake up one morning and Ultra AV is on my computer without any work on my part. I am assuming that is legal either through the T&C or because there is no law banning companies from putting non-harmful $#!↑ on your computer. Correct me if I’m wrong. The point is that I never signed up for Ultra or fulfilled any implied consent if there was a “By leaving out software on your computer, you agree …” since I immediately uninstalled Ultra. I assumed the install was to meet Kaspersky’s legal requirement that I had paid for AV service through XX/XX/2024 and they were not going to give me a pro-rated refund by being banned in the US. OK, I can deal with that.
So I get this charge from Wexway for $59.99 and as I said, not paid and flagged as fraud and since I had no clue who Wexway was I told CapOne don’t pay it. Come to find out, Wexway is the payment company for Ultra AV. So Kaspersky sent Ultra all of my payment information AND signed me up for recurring payments. How is that legal? They effectively signed me up for a contract without my consent or approval. Even if it is in the T&C, from my knowledge of contract law, you cannot authorize yourself to do illegal activities. I eventually got Ultra AV to cancel my subscription through email since they have no phone support so I’m good but I still have the question: is what Kaspersky did re: signing me up at Ultra AV, illegal?
