Frankly, Bricker - and having not read the thread yet, probably a mistake - this is not the seizure of an opposing sign at a political rally, or the relegating of a sign carrier to a free speech zone, both of which I’ll happily oppose no matter who does it.

What it is, it is a police office misunderstanding or misinterpreting the law on threats to a president, even given that it occurred in that known Obama bastion of Oklahoma.

If you can cite a liberal poster criticizing the police confiscation (and the same day return) of a sign reading, “Abort Bush”, and being silent on the current issue, I’ll likely agree with you that that poster should be abashed. Nevertheless, that poster is not me.

I would have no problem with a suit, but it’s not your place to tell the judge how to resolve it. “Push for” this or that, ask the judge for $1 plus the cop has to sit in a corner and no gold star today? Gimme a break. If a civil rights violation is found to have occurred then let it be resolved the way civil rights violations are resolved in our legal system, not the way they’re resolved in Oakminster’s fantasies.

I was standing in a public place (a grammar school) knowing that Bush was going to pass by. I was there first. The Secret Service demanded on pain of arrest (by local cops) that I move and when I did, other people (who happened to be Bush supporters) were ready to occupy the space I was standing. The Secret Service declined to answer under what law they were operating, or whether there was some kind of exclusive use permit or anything like that. This was in 2000 while he was the party nominee and before he was President.

Two different proceedings. One would be an administrative disciplinary proceeding for the cop, initiated by a citizen’s complaint and internal investigation. I know how those work, because I have defended police officers in similar proceedings in the past. The officer can be exonerated, reprimanded, suspended with or without pay, retrained, or fired.

The other action would be the lawsuit, and it is perfectly appropriate to request whatever lawful relief Plaintiff chooses to seek.
